any period or periods <strong>of</strong> paid absence due to sickness (certified by a<br />
medical practitioner), bereavement, jury duty, accident while on duty,<br />
maternity/parental/adoptive leave or leave <strong>of</strong> absence for <strong>Union</strong> business.<br />
All other periods <strong>of</strong> absence, other than those noted above, will reduce an<br />
Employee's vacation entitlement in the same proportion as the factor by<br />
which the period <strong>of</strong> absence relates to the full calendar year.<br />
ARTICLE 15 - LOSS OF TIME ON CITY (HSR) BUSINESS OR ON JURY<br />
DUTY<br />
15.01 (a) Regular Employees held <strong>of</strong>f on <strong>City</strong> (HSR) business by<br />
order <strong>of</strong> the <strong>City</strong> (HSR)'s <strong>of</strong>ficials will be paid what they<br />
would have earned during the period so held <strong>of</strong>f. Spare men,<br />
similarly held from work, will be paid the difference between what<br />
they were able to earn and eight (8) hours at driving rates <strong>of</strong> pay.<br />
All Employees will be reimbursed in a similar manner when<br />
required to attend any Court <strong>of</strong> Jurisdiction, whether or not under<br />
subpoena, including pre-trial hearings, wherein the <strong>City</strong> (HSR) is<br />
co-defendant or plaintiff or when required to appear under<br />
summons by the Crown as a witness in any matter wherein the <strong>City</strong><br />
(HSR) is involved, on condition that any witness fee payable to the<br />
Employee shall revert to the <strong>City</strong> (HSR).<br />
(b)<br />
Off-duty Employees similarly required to attend any Court <strong>of</strong><br />
Jurisdiction, whether or not under subpoena, including pre-trial<br />
hearings, wherein the <strong>City</strong> (HSR) is co-defendant or plaintiff or<br />
when required to appear under summons by the Crown as a<br />
witness in any matter wherein the <strong>City</strong> (HSR) is involved shall be<br />
reimbursed for personal time lost up to eight (8) hours per day at<br />
straight time on condition that any witness fee payable to the<br />
Employee shall revert to the <strong>City</strong> (HSR), and on the further<br />
condition that such time shall not be counted in calculating overtime<br />
or guarantee.<br />
15.02 The <strong>City</strong> (HSR) shall reimburse any permanent Employee who may be<br />
called for Jury Duty in any court <strong>of</strong> law, in the case <strong>of</strong> a regular Employee<br />
for time lost from his regular duties, in the case <strong>of</strong> spare men the<br />
difference between what they are able to earn and eight (8) hours at<br />
driving rates <strong>of</strong> pay, and nothing in the case <strong>of</strong> day-<strong>of</strong>f men, on condition<br />
that any fee payable to the Employee shall revert to the <strong>City</strong> (HSR), and<br />
on the further condition that day-on Employees shall, as court rules permit,<br />
and so far as reasonably practicable, hold themselves available to the<br />
<strong>City</strong> (HSR) within their normal hours <strong>of</strong> work.<br />
