indexing level <strong>of</strong> six percent (6%) per annum based on a C.P.I.<br />
increase <strong>of</strong> ten percent (10%).<br />
(5) The level <strong>of</strong> increase in C.P.I. used in determining the indexing per<br />
cent is the increase as reported by Statistics Canada for all items<br />
for Canada for the preceding year. Pension indexes will be applied<br />
May 1 <strong>of</strong> each year.<br />
17.03 Current Employees at the date <strong>of</strong> ratification (January 19, 1999) whose<br />
Earliest Unreduced Pension Date falls beyond their sixty-fourth (64th)<br />
birthday and who elect to retire under the Pension Plan, whether early or<br />
normal after having attained the age <strong>of</strong> fifty-five (55) years, will be paid the<br />
difference between the Bridging Enhancement benefit amount and the<br />
retirement gratuity amount. The calculation <strong>of</strong> the retirement gratuity will<br />
be as follows:<br />
Having completed fifteen (15) years' service, retirement gratuity equivalent<br />
to one (1) months' pay (calculated based on 22 working days per month)<br />
and in addition thereto one-fifteenth (1/15) <strong>of</strong> one (1) months' pay for each<br />
completed year <strong>of</strong> service above fifteen (15) years to a maximum <strong>of</strong> a<br />
further one (1) months' pay.<br />
An Employee who has been terminated and is pending an arbitration<br />
hearing, shall have their pension status frozen until the arbitrator renders a<br />
decision and the termination is either upheld or the Employee is<br />
reinstated. If reinstated, the Employee has six (6) months to purchase<br />
unpaid pension credits equal to the seniority credited.<br />
Make-up and terms <strong>of</strong> reference <strong>of</strong> Advisory Committee to be determined.<br />
The Committee will meet a minimum <strong>of</strong> three (3) times per year.<br />
As a condition <strong>of</strong> the anticipated sale <strong>of</strong> The Canada Coach Lines Limited,<br />
and as a condition <strong>of</strong> that sale to Trentway-Wagar, the <strong>City</strong> (HSR) agrees<br />
to assume responsibility for continuing the benefits <strong>of</strong> The Canada Coach<br />
Lines Limited retirees on the understanding that the benefits to retirees will<br />
be those in effect on the date <strong>of</strong> the sale and shall not be deemed to<br />
increase, improve or enhance as the result <strong>of</strong> any negotiated changes at<br />
the <strong>City</strong> (HSR) on or after the date <strong>of</strong> the sale, without the expressed<br />
agreement <strong>of</strong> the <strong>Amalgamated</strong> <strong>Transit</strong> <strong>Union</strong>, <strong>Local</strong> <strong>107</strong> and the <strong>City</strong><br />
(HSR).<br />
ARTICLE 18 - FREE TRANSPORTATION<br />
18.01 The <strong>City</strong> (HSR) agrees to provide free transportation for all its Employees<br />
over the regular routes <strong>of</strong> the <strong>City</strong> (HSR) and in accordance with its<br />
