ARTICLE 41 - GENDER<br />
41.01 Wherever the masculine is used in this agreement, it shall be considered<br />
as if the feminine has been used wherever the context so requires.<br />
ARTICLE 42- TECHNOLOGICAL CHANGE<br />
42.01 A minimum <strong>of</strong> sixty (60) days before the introduction <strong>of</strong> any technological<br />
change which directly affects the conditions and terms <strong>of</strong> security or<br />
employment, the <strong>City</strong> (HSR) shall notify the <strong>Union</strong> <strong>of</strong> the proposed<br />
changes. Any such changes shall be the subject <strong>of</strong> discussion between<br />
the <strong>Union</strong> and the <strong>City</strong> (HSR). No Employee with seniority shall be<br />
terminated by the <strong>City</strong> (HSR) provided he has availed himself <strong>of</strong> the <strong>City</strong><br />
(HSR)'s retraining program as soon as such retraining program becomes<br />
available, and the Employee is able to perform the job for which he is<br />
retrained in a manner satisfactory to the <strong>City</strong> (HSR) within three (3)<br />
months <strong>of</strong> being confirmed in the job. An Employee who is not able to<br />
perform the job after retraining and subsequent three (3) month<br />
probationary period will be given the right to bump into any job which he is<br />
immediately able to perform and subject to the provisions <strong>of</strong> Article<br />
19.04(b).<br />
ARTICLE 43 - PERSONNEL FILES<br />
43.01 An Employee who maintains a clear record for a period <strong>of</strong> two (2) years<br />
following their last warning or suspension shall have their record cleared<br />
at the end <strong>of</strong> such period as it applies to warnings and suspensions for<br />
reasons other than irregular attendance.<br />
ARTICLE 44- PRINTING OF COLLECTIVE AGREEMENT<br />
44.01 The <strong>Union</strong> and the <strong>City</strong> (HSR) shall share equally the cost <strong>of</strong> printing<br />
the Collective Agreement, which shall be performed by the <strong>City</strong> <strong>of</strong><br />
<strong>Hamilton</strong>'s internal Print Shop, or alternatively, by a print shop<br />
mutually agreed upon by the parties.<br />
ARTICLE 45- WORKING FUNDS AND CASH RECEIPTS<br />
45.01 (a) Any employee entrusted with money or money's worth in the course<br />
<strong>of</strong> his duties is personally responsible for its safe keeping and<br />
accountability. Employees concerned must produce the monies,<br />
tickets and/or passes, payment vouchers, deposit slips, etc. on<br />
