these benefits will only be provided if similar coverage is not<br />
available to the former Employee from another source; and,<br />
these benefits will terminate on the last day <strong>of</strong> the month in<br />
which the former Employee attains the age <strong>of</strong> sixty-five (65)<br />
years. The benefits continue for the spouse and dependents<br />
until the spouse attains the age <strong>of</strong> sixty-five (65); and,<br />
these benefits terminate upon the death <strong>of</strong> the former<br />

the above benefit coverage will only be available to former<br />
Employees as long as they remain eligible for LTD benefits<br />
pursuant to the claim which was active at the time <strong>of</strong> their<br />

Plans as they exist from time to time.<br />
16.08 The Employer has the right to direct any Employee who has incurred six<br />
(6) or more absences in two (2) consecutive years to a counseling or<br />
medical facility <strong>of</strong> the Employer's choice. The Employer shall pay the full<br />
cost <strong>of</strong> the counseling or medical intervention program.<br />
The Employee has the right to refuse such direction, however, in the event<br />
<strong>of</strong> such refusal, the Employee shall be considered to have received such<br />
counseling or medical intervention.<br />
16.09 (a) Any dispute over the payment <strong>of</strong> benefits shall be adjusted<br />
between the Employee and the Insurance Company.<br />

The Employer will use its best efforts to assist the Employee in<br />
dealing with the Insurance Company and agrees to provide all<br />
documentation and consultation when requested by the Employee<br />
or by the Employee and <strong>Union</strong>.<br />
The Employer agrees to provide that the Employee and a <strong>Union</strong><br />
representative, if the Employee so chooses, may deal directly with<br />
the Insurance Company regarding any dispute over payment <strong>of</strong><br />
benefits.<br />
The Employer agrees to provide the <strong>Union</strong> with copies <strong>of</strong> all<br />
relevant Insurance policies.<br />
