First, the lay-<strong>of</strong>f will be <strong>of</strong>fered to the most senior <strong>Local</strong> <strong>107</strong> Employee(s)<br />

in the affected job classification(s) as per Schedule "A". A senior <strong>Local</strong><br />

<strong>107</strong> Employee(s) who accepts a lay-<strong>of</strong>f shall not have the option <strong>of</strong><br />

displacing any permanent or temporary <strong>Local</strong> t07 Employee(s), as<br />

provided for herein.<br />

Secondly, the <strong>Local</strong> <strong>107</strong> Employee with the least amount <strong>of</strong> Company<br />

seniority in the affected job classification shall be the first to be displaced.<br />

Such displaced <strong>Local</strong> <strong>107</strong> Employee will then (provided she/he has<br />

sufficient qualifications and can demonstrate sufficient knowledge and<br />

ability, during a two (2) month trial period, which includes a two (2) week<br />

familiarization period, to perform the work required) exercise his/her<br />

Company wide seniority within their <strong>Local</strong> by:<br />

(1) transferring to a vacancy through the job posting process, following<br />

the application <strong>of</strong> the articles and/or Collective Agreement and<br />

Letters <strong>of</strong> Agreement, or;<br />

(2) displacing a temporary <strong>Local</strong> <strong>107</strong> Employee performing bargaining<br />

unit work, or;<br />

(3) displacing the most junior <strong>Local</strong> <strong>107</strong> Employee in a classification in<br />

an equal or lower job group, or;<br />

(4) Displacing the most junior <strong>Local</strong> <strong>107</strong> Employee in any classification<br />

if the laid-<strong>of</strong>f <strong>Local</strong> <strong>107</strong> Employee previously held the job on a<br />

permanent or temporary basis for two (2) months or more and<br />

currently meets the qualifications.<br />

All moves are based on Company seniority.<br />

In the case <strong>of</strong> an unsuccessful two (2) months trial period, the previous<br />

<strong>Local</strong> <strong>107</strong> incumbent will be given the option to return to their previous<br />

position.<br />

In the case <strong>of</strong> recalls, the process shall start with the most senior laid-<strong>of</strong>f<br />

<strong>Local</strong> <strong>107</strong> Employee with seniority in the required job classification based<br />

on Company seniority.<br />

The Company shall provide notice <strong>of</strong> lay-<strong>of</strong>f in accordance with the<br />

Employment Standards Act. A copy <strong>of</strong> this notice <strong>of</strong> lay-<strong>of</strong>f will be sent to<br />

the <strong>Union</strong>. Management will also post a copy in a prominent place in the<br />

department(s) affected.<br />
