seniority shall have no bearing on shift, RDO's (regular days <strong>of</strong>f), or assignments,<br />
which will be solely at the discretion <strong>of</strong> the Manager <strong>of</strong> <strong>Transit</strong> Fleet<br />
Maintenance, based on the Apprenticeship Program and the requirements to<br />
cover absences.<br />
LAYOFF<br />
For purposes <strong>of</strong> lay<strong>of</strong>f Article 19.06 will apply.<br />
CANCELLATION OF APPRENTICESHIP<br />
An apprentice who has completed his/her twelve-month preliminary period may<br />
be removed from the Apprenticeship Program and his/her Apprenticeship<br />
Contract cancelled for any <strong>of</strong> the following reasons:<br />
(a) Just cause.<br />
(b)<br />
(c)<br />
If an apprentice fails to take the training/school course when he/she is<br />
scheduled to take same, provided that his/her failure to take such course<br />
is not due to a cause beyond his/her control.<br />
If an apprentice fails a training course at any one level on more than one<br />
occasion.<br />
(d) If the Apprenticeship Board cancels the Apprenticeship Contract.<br />
In the event <strong>of</strong> the apprentice being removed for one <strong>of</strong> the reasons outlined in<br />
b), c) or d), and s/he was a member <strong>of</strong> the bargaining unit immediately prior to<br />
commencing the apprenticeship program, s/he shall be returned to the preapprenticeship<br />
job classification with no loss <strong>of</strong> <strong>ATU</strong> <strong>Local</strong> <strong>107</strong> seniority.<br />
In the event <strong>of</strong> the apprentice being removed for one <strong>of</strong> the reasons outlined in<br />
b), c) or d), and was not a member <strong>of</strong> the <strong>ATU</strong> <strong>Local</strong> <strong>107</strong> bargaining unit at the<br />
start <strong>of</strong> the apprenticeship program s/he shall be laid <strong>of</strong>f as per article 19.06.<br />
TOOL ALLOWANCE<br />
An apprentice's tool allowance shall not be paid in full as per Article 37.07 <strong>of</strong> the<br />
collective agreement. Apprentices shall receive their current progression wage<br />
percentage <strong>of</strong> 7% <strong>of</strong> the value <strong>of</strong> the applicable required tool list;<br />
(a)<br />
(b)<br />
providing that the apprentice has maintained the required tools at his<br />
place <strong>of</strong> work during the year, and<br />
can show receipts <strong>of</strong> purchase for at least the amount <strong>of</strong> the allowance.<br />
Receipts over the required amount in any given year may be carried over<br />
and used in either <strong>of</strong> the following two (2) years.<br />
