without limitation, Long Term Disability benefits, Basic Life<br />

Insurance, Optional Life Insurance, Dependants' Life<br />

Insurance and Accidental Death and Dismemberment<br />

benefits; and<br />

(ii)<br />

subject to paragraph (c), prescription drug benefits for drugs<br />

ordinarily covered by the Ontario Drug Benefit Plan or any<br />

successor thereto.<br />

(c)<br />

In the event that the Ontario Drug Benefit Plan or any successor<br />

thereto is amended such that full time employees who have<br />

attained the age <strong>of</strong> 65 are, or may become ineligible, to receive<br />

prescription drug benefits under that Plan in certain circumstances,<br />

the employer and the union will consider whether it is necessary or<br />

appropriate to amend the provisions <strong>of</strong> clauses (a)(ii) and (b)(ii),<br />

and if so, they will negotiate alternate provisions respecting<br />

prescription drug benefits that do not result in a greater overall cost<br />

to the employer than would have been incurred in the absence <strong>of</strong><br />

such amendments.<br />

16.04 (a) The Employer reserves the right to change the carrier <strong>of</strong> any <strong>of</strong> the<br />

benefit plans provided that the level <strong>of</strong> benefit coverage is not<br />

decreased. Notice <strong>of</strong> such change <strong>of</strong> carrier will be communicated<br />

to the <strong>Union</strong> prior to change.<br />

(b)<br />

Extended Health and Dental Plans shall be administered to<br />

ensure that Employees will not suffer any overall reduction in<br />

benefit value and coverage.<br />

16.05 The <strong>Union</strong> agrees that the Employer may allocate the Employment<br />

Insurance Premium Rebate received for each Employee towards the<br />

annual cost <strong>of</strong> benefit plans.<br />

16.06 Where an Employee recovers funds from a third party any amount claimed<br />

for loss <strong>of</strong> wages or sick leave, shall be repaid to the Employer forthwith<br />

the amount <strong>of</strong> all monies paid to the Employee, for the period for which<br />

such amount is recovered from the third party, provided that the amount to<br />

be repaid to the Employer shall not exceed the amount recovered from the<br />

third party. Should an Employee not arrange a re-payment schedule<br />

within a reasonable period <strong>of</strong> time, after recovery <strong>of</strong> the funds from the<br />

third party, the Employee agrees that the Employer shall have the right to<br />

deduct, from the Employee's regular pays, an amount not to exceed the<br />

amount allowed by law, for the number <strong>of</strong> pays required, in order to<br />

recover said monies.<br />
