Regulatory Context<br />

Executive Order 12898—<strong>Environmental</strong> Justice<br />

Executive Order 12898 (February 11, 1994) requires federal agencies to identify<br />

and address adverse human health or environmental effects of federal programs,<br />

policies, and activities that could be disproportionately high on minority and lowincome<br />

populations. Federal agencies must ensure that federal programs or<br />

activities do not directly or indirectly result in discrimination on the basis of race,<br />

color, or national origin. Federal agencies must provide opportunities for input<br />

into the NEPA process by affected communities and must evaluate the<br />
