• the decision-making body of the lead agency reviewed and<br />

considered the Final EIR prior to approving the project; and<br />

• the Final EIR reflects the lead agency’s independent judgment and<br />

analysis.<br />

After approval of the Project, the CEQA lead agency, CDFG, is required to file a<br />

Notice of Determination with the Office of Planning and Research and the<br />

relevant county clerks within five working days.<br />

Mitigation Monitoring and Reporting Program (CEQA)<br />

CEQA Section 21081.6(a) requires lead agencies to “adopt a reporting and<br />

mitigation monitoring program for the changes to the project which it has<br />

adopted or made a condition of project approval in order to mitigate or avoid<br />

significant effects on the environment.” The Mitigation Monitoring and<br />

Reporting Program (MMRP) required by CEQA is included in Appendix G. The<br />

MMRP will be implemented by USFWS, CDFG, and SLT during and after<br />

project construction.<br />
