H. Range of Sanctions<br />
1. Violations of sections B.1. through<br />
B.10. of this Code may result in<br />
expulsion, unless specific and<br />

significant mitigating factors are<br />
present. Factors to be considered in<br />
mitigation shall be the present<br />
demeanor and past disciplinary<br />
record of the alleged violator, as well<br />
as the nature of the violation and<br />
severity of any damage, injury or<br />
harm resulting from it.<br />
Violations of sections B.11. through<br />
B.13. of this Code may result in<br />
suspension, unless specific and<br />
significant mitigating factors as<br />

specified in section e.1 are present.<br />
Repeated or aggravated violations of<br />
any section of this Code may also<br />
result in expulsion or suspension or in<br />
the imposition of such lesser sanctions<br />
as may be appropriate.<br />
4. Attempts to commit acts prohibited<br />
by this Code may result in imposition<br />
of the same discipline as for actual<br />
misconduct.<br />
5. The sanction imposed in a particular<br />
case should be appropriate and just<br />
depending on the facts of that case.<br />
The burden of establishing facts in<br />
mitigation of expulsion or suspension<br />
will be upon the alleged violator.<br />
Confidentiality of<br />
student records<br />
The Family Educational Rights and Privacy Act (FERPA) affords<br />
students certain rights with respect to their education records.<br />
They are:<br />
(1) The right to inspect and review the student's<br />
education records within 45 days of the day the <strong>College</strong><br />
receives a request for access.<br />
Students should submit to the Registrar or other<br />
appropriate official, written requests that identify the record(s)<br />
they wish to inspect. The Registrar will make arrangements for<br />
access and notify the student of the time and place where the<br />
records may be inspected. Records will be inspected under<br />
the supervision of an appropriate <strong>College</strong> employee. If the<br />
records are not maintained by the <strong>College</strong> official to whom<br />
the request was submitted, that official shall advise the<br />
student of the correct official to whom the request should be<br />
addressed.<br />
(2) The right to request the amendment of the student’s<br />
education records that the student believes are inaccurate or<br />
misleading.<br />
Students may ask the <strong>College</strong> to amend a record that<br />
they believe is inaccurate or misleading. The written request<br />
must clearly identify the part of the record they want<br />
changed, and specify why it is inaccurate or misleading.<br />
I. Appeals<br />
1. Any student found to be in violation<br />
of this Code under the foregoing<br />
procedures may appeal the decision<br />
of the Code of Conduct Committee<br />
directly to the President of the<br />
<strong>College</strong>. An appeal shall stay implementation<br />
of sanctions, but shall not<br />
permit a student removed from<br />
campus to return.<br />
2. The notice of appeal must be<br />
received at the office of the President<br />
of the <strong>College</strong> within five <strong>College</strong><br />
working days of the date of the<br />
Committee’s decision. No particular<br />
form of notice is required.<br />
3. A copy of the notice of appeal must<br />
be filed with the Chairperson of the<br />
Code of Conduct Committee.<br />
4. After a notice of appeal has been<br />
filed, a transcript of the hearing shall<br />
be prepared as soon as practicable<br />
and shall be forwarded to the<br />
President of the <strong>College</strong> and the<br />
appellant or his representative.<br />
If the <strong>College</strong> decides not to amend the record as requested<br />
by the student, the <strong>College</strong> will notify the student of the<br />
decision and advise the student of his or her right to a hearing<br />
regarding the request for amendment. Additional<br />
information regarding the hearing procedures will be<br />
provided to the student when notified of the right to a<br />
hearing.<br />
(3) The right to consent to disclosures of personally identifiable<br />
information contained in the student’s education<br />
records, except to the extent that FERPA authorizes disclosure<br />
without consent.<br />
One exception which permits disclosure without consent<br />
is disclosure to school officials with legitimate educational<br />
interests. A school official is a person employed by the <strong>College</strong><br />
in an administrative, supervisory, academic or research, or<br />
support staff position (including law enforcement unit<br />
personnel and health staff); a person or company with whom<br />
the <strong>College</strong> has contracted (such as an attorney, auditor,<br />
consultant, or collection agent); a person serving on the<br />
Board of Trustees; or a student serving on an official<br />
committee, such as a disciplinary or grievance committee, or<br />
assisting another school official in performing his or her tasks.<br />
A school official has a legitimate educational interest if the<br />
official needs to review an education record in order to fulfill<br />
his or her professional responsibility.<br />
(4) The right to file a complaint with the U.S. Department<br />
of Education concerning alleged failures by <strong>Burlington</strong> <strong>County</strong><br />
<strong>College</strong> to comply with the requirements of FERPA. The name<br />

5. The President of the <strong>College</strong>, within<br />
ten <strong>College</strong> working days of receiving<br />
the notice of appeal, shall either<br />
affirm, reverse, or modify the decision<br />
of the Code of Conduct Committee.<br />
The President’s written decision shall<br />
be forwarded to the student or<br />
his/her representative, to the chief<br />
student development officer, to the<br />
complainant and to the Chairperson<br />
of the Code of Conduct Committee.<br />
The President’s written decision shall<br />
include his/her reasons for arriving at<br />
said decision. Said decision shall be<br />
final.<br />

regulations are on file in the offices of the Registrar, the<br />
Vice President of Student Services, Evening Administrators,<br />
and the Library.<br />
Public notice designating<br />
directory information<br />
BCC hereby designates the following student information as<br />
public or directory information. Such information may be<br />
disclosed by the institution for any purpose, at its discretion:<br />
Name, email address, place of birth, photographs, grade level,<br />
dates of attendance, enrollment status, most recent<br />
educational institution attended, major field of study, awards,<br />
honors and degrees received, height and weight of athletic<br />
team members and participation in officially recognized<br />
activities and sports.<br />
Students may withhold permission to disclose this<br />
information under the Family Educational Rights and Privacy<br />
Act of 1974, as amended (FERPA), by notifying the Registrar’s<br />
Office, in writing, of their intentions. Such notification shall<br />
become effective as of the date on which it is received in the<br />
Registrar’s Office and will remain in effect for the remainder of<br />
the academic year.<br />
