B. Prior to any conveyance <strong>of</strong> real property which has been approved as a sending site, the owner shall deliver<br />

to the prospective owner a written disclosure statement which shall contain all <strong>of</strong> the following:<br />

1. A legal description <strong>of</strong> the real property to be conveyed and if different, a legal description <strong>of</strong> the sending<br />

site; and<br />

2. The total amount <strong>of</strong> Existing Development Rights on the sending site prior to the transfer <strong>of</strong> existing<br />

development rights, and whether such Existing Development Rights derived from existing, approved, demolished,<br />

and/or converted floor area; and<br />

3. The total amount <strong>of</strong> Existing Development Rights that have been transferred from the sending site, and<br />

whether such Existing Development Rights derived from existing, approved, demolished and/or converted floor area;<br />

and<br />

4. A certification that the information is true and correct to the best <strong>of</strong> the owner's knowledge as <strong>of</strong> the date<br />

signed by the owner. The <strong>City</strong> shall not be liable for any error, omission, or inaccuracy contained in such disclosure.<br />

28.95.100 Expiration and Termination <strong>of</strong> Necessary Approvals.<br />

A. An approved development plan for either the sending site(s), the receiving site(s), or both, may be terminated<br />

by the <strong>City</strong>, after a noticed public hearing, if any condition <strong>of</strong> the approval <strong>of</strong> transfer <strong>of</strong> Existing Development<br />

Rights is violated or any other permit or approval necessary to approved development on either the sending or<br />

receiving site(s) or both expires or is otherwise terminated.<br />

B. Recorded Transfers <strong>of</strong> Existing Development Rights pursuant to this Chapter shall not terminate when the<br />

approved development plan for either the sending site, receiving site(s) or both, expires or is otherwise terminated,<br />

and such transferred Existing Development Rights shall remain on the receiving site, and may either be developed<br />

pursuant to a newly approved development plan, or may be transferred to a new receiving site pursuant to this<br />

Chapter. (Ord. 4790, 1992.)<br />

28.95.110 Appeal Procedures.<br />

Determinations by the Planning Commission are appealable to the <strong>City</strong> Council pursuant to Section 1.30.050 <strong>of</strong><br />

the <strong>Municipal</strong> <strong>Code</strong>. (Ord. 4790, 1992.)<br />

28.95.120 Enforceability.<br />

Enforcement <strong>of</strong> this Chapter shall be pursuant to Chapter 28.98 <strong>of</strong> the <strong>Municipal</strong> <strong>Code</strong>. (Ord. 4790, 1992.)<br />

28.95.130 Penalty.<br />

The penalty for violating any provision <strong>of</strong> this Chapter shall be pursuant to Chapter 28.98.002 <strong>of</strong> the <strong>Municipal</strong><br />

ZONING UPON ANNEXATION<br />

In any petition for the annexation <strong>of</strong> property to the <strong>City</strong>, the petitioner may request the zoning desired by him for<br />

the property described in the application in the event the property is annexed to the <strong>City</strong>. Prior to the adoption by the<br />

Council <strong>of</strong> the resolution <strong>of</strong> intention to annex uninhabited territory, or in the case <strong>of</strong> an inhabited proceeding at the<br />

time <strong>of</strong> referral to the Planning Commission pursuant to Section 35108 <strong>of</strong> the Government <strong>Code</strong>, a copy <strong>of</strong> the<br />

annexation petition or request shall be referred to the <strong>City</strong> Planning Commission for investigation and report to the<br />

<strong>City</strong> Council as to the desirability <strong>of</strong> the annexation and the zoning classification to be placed thereon whether or not<br />

a zone classification has been requested. The Planning Commission shall consider the annexation <strong>of</strong> such property<br />

and the zoning to be placed thereon in the event <strong>of</strong> annexation to the <strong>City</strong> and upon completion <strong>of</strong> such consideration,<br />

the Planning Commission shall make its report and recommendations to the Council by resolution.<br />
