Discharges <strong>of</strong> wastewater which in any way violate this Title or any permit or order issued by the Public Works<br />

Director pursuant to this Title are hereby declared a public nuisance and shall be corrected or abated as directed by<br />

the Public Works Director. (Ord. 4589, 1989; Ord. 3883 §1, 1977.)<br />

16.14.020 Injunction.<br />

Whenever a discharge violates any Applicable Regulation or Wastewater Discharge Permit or otherwise causes or<br />

threatens to cause a condition <strong>of</strong> contamination, pollution or nuisance, the agency may petition the Superior Court for<br />

the issuance <strong>of</strong> a preliminary or permanent injunction, or both, as may be appropriate, for the purpose <strong>of</strong> preventing<br />

or restraining the continuance or renewal <strong>of</strong> such discharge. (Ord. 4589, 1989; Ord. 3883 §1, 1977.)<br />

16.14.030 Damage to Facilities.<br />

When a User causes a discharge <strong>of</strong> wastes which obstructs, damages or impairs the POTW or a Community<br />

Sewer, the agency may assess a charge against the User for the work required to clean or repair the facility and add<br />

such charge to the User's sewer service charges. (Ord. 4589, 1989; Ord. 3883 §1, 1977.)<br />

16.14.032 Published Notices <strong>of</strong> Significant Violators.<br />

On or before January 30 <strong>of</strong> each calendar year, and in accordance with the requirements <strong>of</strong> federal law, the agency<br />

shall cause to be published a list <strong>of</strong> the names <strong>of</strong> all persons who during the preceding year have caused or committed<br />

any significant violation <strong>of</strong> any federal categorical pretreatment standards or provisions <strong>of</strong> this Title. The list shall be<br />

published in the newspaper having the largest daily circulation in the agency's service area. (Ord. 4589, 1989.)<br />

16.14.034 Administrative Penalties.<br />

Any provision <strong>of</strong> this Title 16 may be enforced by the Public Works Director acting through use <strong>of</strong> administrative<br />

procedures and imposing administrative civil penalties for violations, as follows:<br />

A. The Public Works Director may determine violations <strong>of</strong> this Title 16 by administrative hearing, and, based<br />

upon the results <strong>of</strong> that hearing, order administrative civil penalty(ies) to be assessed against the party responsible for<br />

the violation, in accord with the provisions <strong>of</strong> this Title 16.<br />

B. In addition to general enforcement through administrative civil penalties as authorized in 16.14.034A, the<br />

Public Works Director is designated to be the hearing <strong>of</strong>ficer for administrative enforcement authorized pursuant to<br />

California Government <strong>Code</strong> Sections 54739 through 54740.6.<br />

C. Hearing, waiver <strong>of</strong> hearing, orders, reconsideration, appeal to the <strong>City</strong> Council, judicial review,<br />

delinquencies, lien, and confirmation regarding administrative remedies under 16.14.034A & B shall be as provided<br />

in California Government <strong>Code</strong> Sections 54740.5, 54740.6 and amendments hereafter adopted to Sections 54740.5<br />

and 54740.6 and in Section 16.12.040 <strong>of</strong> this <strong>Code</strong>.<br />

D. Remedies under this Section are in addition to, and do not supersede or limit the use <strong>of</strong>, any and all other<br />

remedies, civil or criminal, available under this Title 16 and under the statutes and regulations <strong>of</strong> the State <strong>of</strong><br />

California or the United States <strong>of</strong> America.<br />

E. Administrative remedies, fines and other civil penalties imposed pursuant to the provisions <strong>of</strong> this Title 16<br />

may, at the sole discretion <strong>of</strong> the Public Works Director, be added to and collected with the applicable user’s sewer<br />

service charges. (Ord. 5078, 1998; Ord. 4775, 1992; Ord. 4589, 1989.)<br />
