Land Use E - Neighborhood Recreation: This area is to be developed as a common recreation facility available<br />

for use by residents <strong>of</strong> adjoining neighborhood. Uses permitted in Area E are:<br />

1. Playground equipment, picnic areas, active recreation lawn areas, and other incidental amenities appropriate<br />

to this use;<br />

2. Landscaped areas for common use;<br />

3. Open areas required for the protection <strong>of</strong> scenic, habitat or other resources; and<br />

4. Storm drainage improvements and detention areas and related facilities.<br />

Land Use F - Circulation: This area is to be used for roads and on-street parking. Uses permitted in Area F are:<br />

1. Roads;<br />

2. Sidewalks; and<br />

3. On-street parking areas.<br />

28.46.020 Conditions, Restrictions and Modifications.<br />

The Planning Commission may impose such appropriate and reasonable conditions and restrictions as it may<br />

deem necessary for the protection <strong>of</strong> property in the neighborhood or in the interest <strong>of</strong> public health, safety and<br />

welfare in order to carry out the purposes and intent <strong>of</strong> this chapter. However, no variance, modification, or other<br />

approval shall be granted for building height, maximum number <strong>of</strong> residential dwelling units, or maximum residential<br />

dwelling units per acre. (Ord. 4900, 1995.)<br />

28.46.025 Building Height.<br />

No building in this zone shall exceed a height <strong>of</strong> thirty feet (30’) nor exceed the height limitations imposed for the<br />

protection and enhancement <strong>of</strong> solar access by Chapter 28.11 <strong>of</strong> this Title. (Ord. 4900, 1995.)<br />

28.46.035 Front and Interior Setback Requirements.<br />

Residential lots fronting a public or private street shall have a front setback from curb face <strong>of</strong> the roadway <strong>of</strong> not<br />

less than twenty-five feet (25’). Residential lots fronting common open space or driveways shall have a front setback<br />

<strong>of</strong> not less than ten feet (10’). There shall be interior setbacks <strong>of</strong> not less than ten feet (10’). (Ord. 5459, 2008; Ord.<br />

28.46.040 Residential Lot Area Requirements for Parcels in the Zone.<br />

Residential lots shall have no less than 6,500 square feet. (Ord. 4900, 1995.)<br />

28.46.045 Off-Street Parking.<br />

Off-street parking shall be provided as required in Chapter 28.90 <strong>of</strong> this Title. Notwithstanding Chapter 28.90, no<br />

more than five spaces shall adjoin each other without intervening landscaping areas. It is the intent <strong>of</strong> this Chapter<br />

that parking areas shall not dominate open space and landscaping areas. (Ord. 4900, 1995.)<br />

28.46.050 Street Requirements.<br />

If necessary to preserve natural terrain features and open space, the Planning Commission may grant<br />

modifications <strong>of</strong> <strong>City</strong> street design standards as may be deemed necessary to assure that the intent <strong>of</strong> this Chapter is<br />

observed and the public welfare and safety secured. (Ord. 4900, 1995.)<br />

28.46.055 Restrictions on Usage <strong>of</strong> Signs.<br />

Signs shall be permitted in this zone only as provided in the Sign Ordinance, Chapter 22.70 <strong>of</strong> this Title. (Ord.<br />

4900, 1995.)<br />

28.46.060 Architectural Review Requirements for Development.<br />

Notwithstanding the applicability standards <strong>of</strong> Chapter 22.68 <strong>of</strong> this Title, all development within the SP-5 Zone<br />

shall be subject to the review and approval <strong>of</strong> the Architectural Board <strong>of</strong> Review. (Ord. 4900, 1995.)<br />
