(b) Exemption from Towing Fees. If the citation is not filed, dismissed on motion <strong>of</strong> the prosecution, or if the<br />

person receiving the citation is acquitted <strong>of</strong> the violation by a court <strong>of</strong> competent jurisdiction, the owner or person<br />

entitled to possession <strong>of</strong> the vehicle shall not be liable for any costs for towing fees and up to seventy-two (72) hours<br />

storage fees.<br />

(c) Notice. Notice <strong>of</strong> the four (4) options for recovery shall be posted in all places where members <strong>of</strong> the public<br />

come to recover removed vehicles and in the appropriate areas <strong>of</strong> the Police station. Such notice shall be legible and<br />

clearly visible for members <strong>of</strong> the public who come to recover such vehicles. (Ord. 4249, 1984; Ord. 4011 §1, 1979;<br />

Ord. 3969, 1978.)<br />

10.44.030 Emergency Parking Signs.<br />

(a) Whenever the Chief <strong>of</strong> Police shall determine that an emergency traffic congestion is likely to result from the<br />

holding <strong>of</strong> public or private assemblages, gatherings or functions, or for other reasons, the Chief <strong>of</strong> Police shall have<br />

power and authority to order temporary signs to be erected or posted indicating that the operation, parking or standing<br />

<strong>of</strong> vehicles is prohibited on such streets and alleys as the Chief <strong>of</strong> Police shall direct during the time such temporary<br />

signs are in place. Such signs shall remain in place only during the existence <strong>of</strong> such emergency and the Chief <strong>of</strong><br />

Police shall cause such signs to be removed promptly thereafter.<br />

(b) Any vehicle parked contrary to the directions and provisions <strong>of</strong> signs erected or placed pursuant to<br />

Subsection (a) may be removed or caused to be removed from any street by a Police Officer in the manner and<br />

subject to the provisions <strong>of</strong> the California Vehicle <strong>Code</strong> if such signs give notice that such vehicle may be removed<br />

and are erected or placed at least twenty-four (24) hours prior to the removal <strong>of</strong> such vehicle.<br />

(c) When signs authorized by the provisions <strong>of</strong> Subsection (a) are in place, no person shall operate, park or stand<br />

any vehicle contrary to the directions and provisions <strong>of</strong> such signs. (Ord. 2994 §2, 1964; Ord. 2713 §1(part), 1959;<br />

10.44.032 Temporary Signs when Street Work Being Done.<br />

(a) Whenever the Street Superintendent shall determine that the use <strong>of</strong> a street or portion there<strong>of</strong> is necessary for<br />

the cleaning, repair or construction <strong>of</strong> the street or for the installation <strong>of</strong> underground utilities, other than water and<br />

sewer, he shall have the power and authority to order temporary signs to be erected or posted indicating that the<br />

parking <strong>of</strong> vehicles is prohibited on such street during such times as are indicated on such temporary signs.<br />

(b) Any vehicle parked contrary to the directions and provisions <strong>of</strong> signs erected or placed pursuant to<br />

Subsection (a) may be removed or caused to be removed from any street by a Police Officer in the manner and<br />

subject to the provisions <strong>of</strong> the California Vehicle <strong>Code</strong> if such signs give notice that such vehicle may be removed<br />

and are erected or placed at least twenty-four (24) hours prior to the removal <strong>of</strong> such vehicle.<br />

(c) When signs authorized by the provisions <strong>of</strong> Subsection (a) are in place, no person shall operate, park or stand<br />

any vehicle contrary to the directions and provisions <strong>of</strong> such signs. (Ord. 3269 §1, 1968.)<br />

10.44.034 Water and Sewer System Work.<br />

(a) Whenever it is necessary to use any street or portion there<strong>of</strong> for a purpose by or on behalf <strong>of</strong> the <strong>City</strong> which<br />

is not specified in Sections 10.44.030 or 10.44.032, and which is other than for the normal flow <strong>of</strong> traffic, and it is<br />

determined that the parking <strong>of</strong> vehicles along such street would prohibit or interfere with such use <strong>of</strong> the street, the<br />

head <strong>of</strong> the <strong>City</strong> department having control over the particular use <strong>of</strong> the street shall have power and authority to<br />

order temporary signs to be erected or posted indicating that the parking <strong>of</strong> vehicles is prohibited on such street<br />

during such times as are indicated on such temporary signs. Uses <strong>of</strong> the street included in this section include but are<br />

not limited to work done in connection with the <strong>City</strong> water facilities, the <strong>City</strong> sanitary sewer system and the <strong>City</strong><br />

street trees.<br />

(b) Any vehicle parked contrary to the directions and provisions <strong>of</strong> signs erected or placed pursuant to<br />

Subsection (a) may be removed or caused to be removed from any street by a Police Officer in the manner and<br />

subject to the provisions <strong>of</strong> the California Vehicle <strong>Code</strong> if such signs give notice that such vehicle may be removed<br />

and are erected or placed at least twenty-four (24) hours prior to the removal <strong>of</strong> such vehicle.<br />

(c) When signs authorized by the provisions <strong>of</strong> Subsection (a) are in place, no person shall operate, park or stand<br />

10.44.040 Parking for Certain Purposes Prohibited.<br />

No person shall park a vehicle upon any street for the principal purpose <strong>of</strong>:<br />

(1) Displaying such vehicle for sale.<br />

(2) Repairing such vehicle except repairs necessitated by an emergency.<br />

(3) Washing such vehicle except by the owner or by a person under direct control or supervision by the owner <strong>of</strong><br />

such vehicle. (Ord. 2713 §1(part), 1959; prior <strong>Code</strong> §31.74.)<br />
