B. ISSUANCE OF AN APPROVAL FOR THE RELOCATION, DEMOLITION, OR ALTERATION OF<br />

A CITY LANDMARK. In issuing an approval for the alteration <strong>of</strong> a <strong>City</strong> Landmark pursuant to this Section, the<br />

Commission shall make one or more <strong>of</strong> the findings required by Subsection (A) here<strong>of</strong> in addition to imposing<br />

mitigation measures as conditions <strong>of</strong> approval consistent with such findings.<br />

C. ALTERATIONS TO A PROPOSED LANDMARK. No structure, natural feature, or site recommended<br />

for designation as a Landmark pursuant to Section 22.22.050 here<strong>of</strong> shall be altered on the exterior, relocated, or<br />

demolished after adoption by the Commission <strong>of</strong> a resolution <strong>of</strong> intention for such designation, except pursuant to the<br />

requirements <strong>of</strong> this Section.<br />

D. APPEALS TO THE CITY COUNCIL. A final decision made by the Historic Landmarks Commission<br />

pursuant to the provisions <strong>of</strong> this Section may be appealed to the <strong>City</strong> Council pursuant to the requirements <strong>of</strong> <strong>Santa</strong><br />

<strong>Barbara</strong> <strong>Municipal</strong> <strong>Code</strong> Chapter 1.30. Any decision by the <strong>City</strong> Council on appeal pursuant to this Section shall<br />

comply with the finding requirements <strong>of</strong> Subparagraph (A) here<strong>of</strong> as well as the applicable requirements and<br />

provisions <strong>of</strong> the California Environmental Quality Act.<br />

E. SIGNIFICANT PRUNING OR REMOVAL OF AN HISTORIC TREE. The significant pruning or<br />

removal <strong>of</strong> an historic tree is processed and regulated in accordance with Chapter 15.24 <strong>of</strong> this <strong>Code</strong>. (Ord. 5505,<br />

2009; Ord. 5333, 2004; Ord. 4848, 1994; Ord. 4029, 1979; Ord. 3900 §1, 1977.)<br />

22.22.085 Designation <strong>of</strong> Structures <strong>of</strong> Merit.<br />

A. DESIGNATIONS. The <strong>City</strong> has established the Structure <strong>of</strong> Merit designation in order to encourage the<br />

preservation <strong>of</strong> the <strong>City</strong>'s historic and architecturally significant structures, sites, or features under circumstances<br />

where such buildings and sites do not rise to the level <strong>of</strong> a <strong>City</strong> Landmark. The Commission may designate as a<br />

Structure <strong>of</strong> Merit any structure not designated as a Landmark but deserving <strong>of</strong> <strong>of</strong>ficial <strong>City</strong> recognition as having<br />

historic, architectural, archaeological, cultural or aesthetic significance.<br />

B. CRITERIA FOR STRUCTURE OF MERIT DESIGNATION. In considering a proposal for designation<br />

<strong>of</strong> a Structure <strong>of</strong> Merit, the Commission shall apply the considerations and criteria provided for Landmarks in Section<br />

22.22.040 <strong>of</strong> this Chapter. Some <strong>of</strong> the determining factors in the appropriateness <strong>of</strong> a Structure <strong>of</strong> Merit designation<br />

rather than a <strong>City</strong> Landmark designation are the following: 1. the amount <strong>of</strong> eligibility criteria found applicable; 2.<br />

the level <strong>of</strong> original structural or historical integrity <strong>of</strong> the Historic Resource; and, 3. the quality or number <strong>of</strong><br />

resources <strong>of</strong> this type remaining within the <strong>City</strong>.<br />

C. NOTICE OF INTENT TO DESIGNATE A STRUCTURE OF MERIT. Except for those structures, sites<br />

or features designated Structures <strong>of</strong> Merit pursuant to the demolition regulations <strong>of</strong> Section 22.22.035 and Section<br />

22.22.037, prior to taking action to designate a structure as a <strong>City</strong> Structure <strong>of</strong> Merit, the Commission shall adopt a<br />

resolution <strong>of</strong> intention announcing its intention to consider such a designation at a hearing to be held not less than<br />

seventy five (75) days after the adoption <strong>of</strong> the Resolution, unless the owner <strong>of</strong> the property proposed for designation<br />

consents in writing to a lesser period <strong>of</strong> notice. Prior to conducting the public hearing required by this subsection for<br />

the designation <strong>of</strong> an identified structure, site, or feature, the owner(s) <strong>of</strong> the real property upon which the structure or<br />

feature is located (as such ownership is listed on the last equalized County <strong>of</strong> <strong>Santa</strong> <strong>Barbara</strong> Assessment Roll) shall be<br />

provided with a copy <strong>of</strong> the Commission resolution and a written notice <strong>of</strong> the Commission hearing by depositing a<br />

notice there<strong>of</strong> in the regular United States Mail not less than sixty (60) days prior to the scheduled hearing date. Such<br />

notice shall, at a minimum, contain the notice information required by state Government <strong>Code</strong> Section 65094, as<br />

currently enacted or hereinafter amended.<br />

D. HEARING OF STRUCTURE OF MERIT DESIGNATION. At the scheduled Commission hearing, the<br />

property owner or owner’s representative and the <strong>City</strong> staff shall be entitled to present relevant evidence, both oral<br />

and written, to establish whether the structure has appropriate potential for possible designation as a <strong>City</strong> Historic<br />

Resource. Upon completion <strong>of</strong> the public hearing, the Commission shall vote to adopt or to not adopt a resolution <strong>of</strong><br />

the Commission designating the structure, site or feature as a <strong>City</strong> Structure <strong>of</strong> Merit.<br />

E. APPEALS TO THE CITY COUNCIL. A final decision made by the Commission pursuant to the<br />

provisions <strong>of</strong> this Section may be appealed to the <strong>City</strong> Council pursuant to the requirements <strong>of</strong> <strong>Santa</strong> <strong>Barbara</strong><br />

<strong>Municipal</strong> <strong>Code</strong> Chapter 1.30.<br />

F. RECORDATION OF RESOLUTION OF DESIGNATION. Upon the Commission’s adoption <strong>of</strong> a<br />

resolution <strong>of</strong> designation as a <strong>City</strong> Structure <strong>of</strong> Merit (or upon a final decision <strong>of</strong> the <strong>City</strong> Council on an appeal <strong>of</strong><br />

such a designation), the Community Development Director shall cause such resolution <strong>of</strong> designation to be recorded<br />

with respect to the real property there<strong>of</strong> in the Office <strong>of</strong> the Recorder <strong>of</strong> the County <strong>of</strong> <strong>Santa</strong> <strong>Barbara</strong> within sixty (60)<br />

days <strong>of</strong> the Commission’s adoption <strong>of</strong> the resolution <strong>of</strong> designation. (Ord. 5333, 2004; Ord. 4848, 1994; Ord. 3900<br />

§1, 1977.)<br />

22.22.090 Demolition, Relocation, or Alteration <strong>of</strong> a Structure <strong>of</strong> Merit.<br />

A. ALTERATIONS TO A STRUCTURE OF MERIT – REQUIRED FINDINGS. No Structure <strong>of</strong> Merit<br />

shall be altered on the exterior, relocated, or demolished except where the Historic Landmarks Commission has made<br />

one or more <strong>of</strong> the following findings:<br />

1. The exterior alterations are being made for the purposes <strong>of</strong> restoring the Structure <strong>of</strong> Merit to its original<br />

appearance or in order to substantially aid its preservation or enhancement as a Historic Resource.<br />

2. The relocation <strong>of</strong> the Structure <strong>of</strong> Merit will substantially aid in its long-term preservation or<br />

enhancement as a Historic Resource.<br />
