PLANNING COMMISSION<br />

The Planning Commission <strong>of</strong> the <strong>City</strong> shall exercise the following functions:<br />

1. All actions provided by the Zoning Ordinance to be performed by the Planning Commission in connection<br />

with applications for modifications, variances, special use permits, conditional use permits, site plans, plot plans,<br />

development plans and planned residence developments.<br />

2. Make recommendations to the <strong>City</strong> Council for amendments to the text <strong>of</strong> the Zoning Ordinance.<br />

3. Act as Advisory Agency for subdivisions as provided for in Title 27 <strong>of</strong> this <strong>Code</strong>.<br />

4. In making those land use decisions authorized for the Planning Commission by Title 28 <strong>of</strong> the <strong>Municipal</strong><br />

<strong>Code</strong>, the Commission shall take into consideration the comments <strong>of</strong> the Architectural Board <strong>of</strong> Review provided<br />

pursuant to the requirements <strong>of</strong> Section 22.68.045 or the Historic Landmarks Commission pursuant to Section<br />

22.22.145 (as the appropriate case may be) and, in issuing a project approval or a project denial, the Commission<br />

shall provide written comments on how the ABR or HLC comments affected the Commission’s decision.<br />

5. Such other functions as may be assigned by the <strong>City</strong> Council. (Ord. 5464, 2008; Ord. 5380, 2005; Ord. 3904<br />

GENERAL PLAN AMENDMENT<br />

In the event that the Planning Commission agrees to hold a hearing on a General Plan amendment, other than upon<br />

its own initiative or upon request <strong>of</strong> the <strong>City</strong> Council, the person seeking the General Plan amendment shall pay to the<br />

<strong>City</strong> the fee established by resolution <strong>of</strong> the <strong>City</strong> Council. Said fee shall be paid within five (5) days <strong>of</strong> the Planning<br />

Commission decision to hold the public hearing. (Ord. 3955, 1978.)<br />

The procedure for the preparation, adoption and administration <strong>of</strong> specific plans shall be as provided by Articles 8,<br />

9, and 10 <strong>of</strong> Chapter 3 <strong>of</strong> Division 1 <strong>of</strong> Title 7 <strong>of</strong> the California Government <strong>Code</strong> (commencing with Section 65450<br />

et seq.), as most recently amended, except that a specific plan may only be approved or amended in the same manner<br />

that the general plan may be approved or amended pursuant to Section 1507 <strong>of</strong> the <strong>City</strong> Charter. (Ord. 4279, 1984.)<br />

28.08.020 Issuance <strong>of</strong> Building Permits.<br />

A building permit shall not be issued for any structure, alteration or use that is inconsistent with an adopted<br />

specific plan unless an exception is granted by the Community Development Director upon finding that the project<br />

allowed by the building permit would not impair the <strong>City</strong>'s ability to complete or implement the Specific Plan. (Ord.<br />
