G. Has been convicted <strong>of</strong> operating a vehicle while under the influence <strong>of</strong> alcohol or drugs two (2) or more<br />

times within seven (7) years immediately preceding the application for a permit or a renewal application, or one (1)<br />

time within one (1) year immediately preceding application for a permit or renewal.<br />

H. Has a history <strong>of</strong> chronic alcohol-related criminal convictions, as evidenced by three (3) or more public<br />

intoxication convictions within two (2) years immediately preceding an application for or renewal <strong>of</strong> permit.<br />

I. Has two (2) or more moving violation convictions within one (1) year immediately preceding an application<br />

for a permit, or three (3) moving violation convictions within one (1) year, or four (4) moving violation convictions<br />

within two (2) years for renewal. ”Moving violation” conviction shall mean those violations set forth in State Vehicle<br />

<strong>Code</strong> Section 12810.<br />

J. Has been convicted <strong>of</strong> a felony or misdemeanor hit and run.<br />

K. Has falsified or omitted material and relevant facts on the public vehicle driver’s permit application.<br />

L. Has failed to comply with all applicable provisions <strong>of</strong> Section 5.29.175 <strong>of</strong> this Chapter. (Ord. 5360, 2005;<br />

Ord. 4974, 1996; Ord. 4277, 1984; Ord. 4206, 1983.)<br />

5.29.200 Issuance <strong>of</strong> Public Vehicle Driver's Permit.<br />

A. If the Chief <strong>of</strong> Police finds that the driver applicant is duly qualified, the Chief <strong>of</strong> Police shall promptly and<br />

expeditiously issue a public vehicle driver's permit to the applicant.<br />

B. A permit card shall contain a recent picture <strong>of</strong> the permittee, affixed in such a manner that another picture<br />

cannot be substituted without detection. The driver's permit shall also contain the driver's full name, permit number,<br />

and the expiration date <strong>of</strong> such permit. The Chief <strong>of</strong> Police shall furnish a driver's permit which shall at all times be<br />

conspicuously displayed in a suitable container in the vehicle the driver is operating. It shall be unlawful to operate a<br />

vehicle licensed under this Chapter without the driver's public vehicle driver's permit being conspicuously displayed<br />

in said vehicle.<br />

C. Unless voided by operation <strong>of</strong> Section 5.29.175 <strong>of</strong> this Chapter, or surrendered, suspended or revoked,<br />

driver's permits shall be valid for one (1) year from the date <strong>of</strong> issuance. Driver's permits may be renewed for a two<br />

(2) year period provided:<br />

1. That the Chief <strong>of</strong> Police's investigation <strong>of</strong> the driver's traffic and criminal record reveals no criminal or<br />

traffic violation during the period the permit was valid, and<br />

2. The previous permit has not expired or become void by operation <strong>of</strong> Section 5.29.175 <strong>of</strong> this Chapter.<br />

If the investigation reveals a violation under subsection 1. above, the permit may be renewed for one (1) year<br />

only. If it reveals a violation under subsection 2. above, a new application will be required.<br />

D. The permit is the property <strong>of</strong> the <strong>City</strong> and is not transferable to any other driver. (Ord. 5360, 2005; Ord.<br />

4974, 1996; Ord. 4206, 1983.)<br />

5.29.210 Change <strong>of</strong> Address or Employer.<br />

Upon change <strong>of</strong> name, address, telephone number or employer, a driver shall notify the owner's permit holder and<br />

the Chief <strong>of</strong> Police in writing within five (5) days. (Ord. 5360, 2005; Ord. 4206, 1983.)<br />

5.29.215 Leave <strong>of</strong> Absence.<br />

A driver and the company owner shall notify the Chief <strong>of</strong> Police in writing no less than five (5) days before a<br />

driver begins any leave <strong>of</strong> absence from employment with an owner lasting for a period <strong>of</strong> more than thirty (30) days.<br />

If during a driver’s leave <strong>of</strong> absence the driver’s permit expires, renewal fees shall be paid prior to the leave <strong>of</strong><br />

absence or prior to the expiration date <strong>of</strong> the driver’s permit. Any driver whose leave <strong>of</strong> absence is for a period <strong>of</strong><br />

one (1) year or longer shall be required to reapply as a new driver. (Ord. 5360, 2005.)<br />

5.29.220 Surrender, Suspension, Revocation <strong>of</strong> Public Vehicle Driver's Permit.<br />

A. The Chief <strong>of</strong> Police may suspend or revoke the public vehicle driver's permit <strong>of</strong> any person licensed under<br />

this Chapter for a period not to exceed thirty (30) days for any <strong>of</strong> the following:<br />

1. Repeated and persistent violations <strong>of</strong> the traffic and parking laws <strong>of</strong> the <strong>City</strong> or the state Vehicle <strong>Code</strong>.<br />

2. Conviction for misdemeanor or felony reckless driving.<br />

3. Driving any vehicle known to the driver not to be in good order and repair.<br />

4. Violation <strong>of</strong> Section 5.29.100 in any twelve (12) month period.<br />

5. Falsifying or omitting material and relevant facts on an application for a public vehicle driver's permit.<br />

6. Conviction or plea <strong>of</strong> nolo contendere to the violation <strong>of</strong> any law involving alcohol.<br />

7. Conviction or plea <strong>of</strong> nolo contendere to the violation <strong>of</strong> any law involving moral turpitude.<br />

8. Operating any vehicle in a manner which constitutes a misdemeanor under the laws <strong>of</strong> the State <strong>of</strong><br />

California.<br />

9. Conviction <strong>of</strong> a misdemeanor or felony “crime <strong>of</strong> violence” defined as a crime that by its nature poses a<br />

substantial risk <strong>of</strong> the use, attempted use, or threatened use <strong>of</strong> physical force against another person or property <strong>of</strong><br />

another. A crime <strong>of</strong> violence may include, but is not limited to, the following crimes: domestic abuse, murder,<br />

manslaughter, criminal vehicular homicide and injury, assault, sexual assault, use <strong>of</strong> drugs to injure or to facilitate<br />

crime, robbery, burglary, kidnapping, false imprisonment, incest, rape, neglect or endangerment <strong>of</strong> a child, arson,<br />

terrorist threats, or stalking.<br />
