5.29.170 Vehicle Permit and Identification Number.<br />

A. For each vehicle covered by an owner's permit, a vehicle permit with an identification number shall be<br />

assigned by the Chief <strong>of</strong> Police.<br />

B. The vehicle identification number shall be displayed on the vehicle's front and rear exterior, plainly printed in<br />

letters <strong>of</strong> at least three (3) inches in height, and visible to each passenger. (Ord. 5360, 2005; Ord. 4206, 1983.)<br />

5.29.175 Applicability <strong>of</strong> Government <strong>Code</strong> Section 53075.5.<br />

The provisions <strong>of</strong> Section 53075.5 <strong>of</strong> the California Government <strong>Code</strong>, as now or hereafter amended, shall apply<br />

to the issuance, denial, surrender, suspension, and revocation <strong>of</strong> a public vehicle driver's permit pursuant to this<br />

Chapter. (Ord. 4974, 1996.)<br />

5.29.180 Public Vehicle Driver's Permit.<br />

A. It shall be unlawful for any person to drive a vehicle regulated pursuant to this Chapter unless such person<br />

obtains a <strong>City</strong> public vehicle driver's permit in addition to those motor vehicle driver's licenses required by the State<br />

<strong>of</strong> California.<br />

B. Application for such a permit shall be made in person to the Chief <strong>of</strong> Police.<br />

C. The applicant shall provide requested information under oath or affirmation on forms supplied by the Chief<br />

<strong>of</strong> Police.<br />

D. When an application has been denied, the applicant may not reapply for a public vehicle driver's permit for<br />

one (1) calendar year from the date <strong>of</strong> denial, unless denial was without prejudice.<br />

E. The Chief <strong>of</strong> Police shall investigate the facts stated in an application for a public vehicle driver's permit and<br />

other relevant data. (Ord. 5360, 2005; Ord. 4206, 1983.)<br />

5.29.185 Public Vehicle Driver's Permit Application.<br />

An applicant for a public vehicle driver’s permit shall appear in person and file with the Chief <strong>of</strong> Police a sworn<br />

application for such a permit stating, including or affixing the following:<br />

A. The full name and address <strong>of</strong> the driver applicant.<br />

B. The residence addresses <strong>of</strong> the driver applicant for the preceding five (5) years.<br />

C. The names and business addresses <strong>of</strong> the driver applicant’s employers during the preceding five (5) years.<br />

D. A statement as to whether any license, permit or certificate issued to the applicant has been denied, revoked<br />

or suspended by any public authority. The circumstances <strong>of</strong> said denial, revocation, or suspension shall also be fully<br />

explained.<br />

E. A statement as to whether or not the driver applicant has been convicted <strong>of</strong> any crime, whether a felony or<br />

misdemeanor, or violation <strong>of</strong> any municipal ordinance (other than minor traffic and parking <strong>of</strong>fenses), and if so, the<br />

nature <strong>of</strong> the <strong>of</strong>fense and the punishment or penalty assessed for the conviction.<br />

F. The name and business number <strong>of</strong> the taxi company by whom the applicant will be employed or engaged<br />

under contract as a taxi driver.<br />

G. The endorsement by the owner employing the applicant as a taxi driver that the applicant has acquired<br />

pr<strong>of</strong>icient knowledge <strong>of</strong> the traffic laws <strong>of</strong> the State <strong>of</strong> California and the <strong>City</strong>, and <strong>of</strong> the streets <strong>of</strong> the <strong>City</strong>, and to<br />

safely operate a taxi in the <strong>City</strong>.<br />

H. Pro<strong>of</strong> <strong>of</strong> Compliance with Federal and State controlled substance and alcohol testing requirements, including<br />

pro<strong>of</strong> that the driver has tested negative for controlled substances and for alcohol.<br />

I. Pro<strong>of</strong> <strong>of</strong> current <strong>City</strong> Business License Tax Certificate.<br />

J. A signed statement from the hiring taxi company that they have thoroughly reviewed and discussed the <strong>City</strong><br />

<strong>of</strong> <strong>Santa</strong> <strong>Barbara</strong> Paratransit Ordinance and any associated rules and regulations with the driver.<br />

K. Such additional information as may be required by the Chief <strong>of</strong> Police. (Ord. 5360, 2005.)<br />

5.29.190 Denial.<br />

A public vehicle driver's permit shall not be issued to any person for whom any <strong>of</strong> the following is applicable:<br />

A. Has been a licensed driver for less than 6 months in the United States.<br />

B. Does not possess a valid Class C driver's license issued by the State <strong>of</strong> California.<br />

C. Is less than twenty-one (21) years <strong>of</strong> age, unless the applicant possesses a valid Class B driver's license<br />

issued by the State <strong>of</strong> California and is 18 years or older.<br />

D. Is currently required to register pursuant to Section 290 <strong>of</strong> the California Penal <strong>Code</strong> or is required to register<br />

in another state or country as a sex <strong>of</strong>fender in a manner comparable to Penal <strong>Code</strong> Section 290.<br />

E. Has been convicted <strong>of</strong> a crime involving moral turpitude, narcotics or dangerous drugs, unless a period <strong>of</strong> not<br />

less than three (3) years shall have elapsed since the date <strong>of</strong> conviction or the date <strong>of</strong> release from confinement for<br />

such <strong>of</strong>fense, whichever is later.<br />

F. Has been convicted for driving a vehicle recklessly within the two (2) years immediately preceding<br />

application for a permit or renewal.<br />
