(1) The name, address and telephone number <strong>of</strong> the person from whom each such bicycle or bicycle frame was<br />

purchased or otherwise acquired;<br />

(2) The description <strong>of</strong> such bicycle or bicycle frame purchased or otherwise acquired;<br />

(3) The frame number there<strong>of</strong>;<br />

(4) The number <strong>of</strong> any previously issued license decal or plate found attached thereto and any registration<br />

symbols and/or identifying letters preceding the corresponding serial numbers die-stamped to the frame.<br />

In addition to any other reports required in accordance with the provisions <strong>of</strong> this chapter, every person,<br />

partnership, association or corporation engaged in the business <strong>of</strong> selling secondhand bicycles or bicycle frames from<br />

a bicycle establishment is required to make a report to the Chief <strong>of</strong> Police concerning all such bicycles or bicycle<br />

frames sold. Such report shall be made in writing within twenty-four (24) hours <strong>of</strong> the date <strong>of</strong> sale and shall specify:<br />

(1) The name, address and phone number <strong>of</strong> the person to whom each such bicycle or bicycle frame was sold or<br />

otherwise disposed <strong>of</strong>;<br />

(2) The description <strong>of</strong> such bicycle or bicycle frame sold, or otherwise disposed <strong>of</strong>;<br />

(3) The frame number there<strong>of</strong>;<br />

(4) The number <strong>of</strong> any previously issued license decal or plate found attached thereto and any registration<br />

symbol and/or identifying letters preceding the corresponding serial numbers die-stamped to the frame.<br />

Reports <strong>of</strong> purchases or otherwise acquired bicycles or bicycle frames and/or reports <strong>of</strong> the sale or otherwise<br />

disposal <strong>of</strong> bicycle or bicycle frames shall be made in triplicate. The original shall be mailed or delivered to the Chief<br />

<strong>of</strong> Police, the duplicate shall be given to the buyer/seller, and the triplicate shall be kept by the bicycle establishment<br />

as a permanent record. The provisions <strong>of</strong> this section shall not apply to new bicycles or new bicycle frames<br />

purchased at wholesale.<br />

No person, partnership, association or corporation operating a bicycle establishment shall purchase, sell,<br />

exchange, barter, repair, remodel, dismantle, or junk any bicycle, bicycle frame, or bicycle part from any person<br />

under the age <strong>of</strong> eighteen (18) years, or any person under the influence <strong>of</strong> any narcotics, drugs and/or intoxicating<br />

beverages. (Ord. 3795, 1975.)<br />

10.52.080 Removal <strong>of</strong> Frame Identification Numbers - Police Authorized to Number Frames.<br />

No person shall willfully or maliciously remove, destroy, mutilate or alter the number <strong>of</strong> any bicycle frame<br />

licensed pursuant to this chapter.<br />

Nothing in this chapter shall prohibit the Police Department from stamping numbers on the frames <strong>of</strong> bicycles on<br />

which no serial number can be found or on which the number is illegible or insufficient for identification purposes.<br />

10.52.090 Impounding <strong>of</strong> Unlawfully Operated Bicycles - Duty <strong>of</strong> Tax and Permit Inspector or Police Officer<br />

- Redemption.<br />

The Tax and Permit Inspector and any Police Officer <strong>of</strong> the <strong>City</strong> may take any bicycle found by him to be<br />

operated or used upon the streets <strong>of</strong> the <strong>City</strong> in violation <strong>of</strong> this chapter and impound the same at the <strong>City</strong> Hall or<br />

other convenient place, which bicycle may be redeemed by the owner there<strong>of</strong>, upon payment <strong>of</strong> the license fee and<br />

licensing as required for such bicycle. (Ord. 3795, 1975.)<br />

10.52.100 Impounding - Sale <strong>of</strong> Unclaimed Bicycles - Disposition <strong>of</strong> Sale Proceeds.<br />

In the event any bicycle impounded by the Police Department is unclaimed by the owner within a period <strong>of</strong> four<br />

(4) months after it is impounded, the same shall be sold at public auction after notice <strong>of</strong> at least three (3) days by<br />

posting a notice <strong>of</strong> the time and place <strong>of</strong> the sale and a brief description <strong>of</strong> the bicycle in three (3) public places in the<br />

<strong>City</strong>. (Ord. 3795, 1975.)<br />

10.52.110 Police Department to Administer Provisions <strong>of</strong> Chapter.<br />

The Police Department <strong>of</strong> the <strong>City</strong> is authorized and directed to administer the provisions <strong>of</strong> this chapter. (Ord.<br />

3795, 1975.)<br />

10.52.120 Manner <strong>of</strong> Riding Bicycle.<br />

No person operating a bicycle shall permit any person to ride upon such bicycle except on a seat or package<br />

carrier four (4) or more inches in width securely fastened to the bicycle in the rear <strong>of</strong> the person operating the bicycle.<br />

10.52.130 No Bicycles on Sidewalk.<br />

No person shall ride a bicycle on any sidewalk except at a driveway; provided, that a person may ride a bicycle on<br />

any area designated by the <strong>City</strong> Council as a bikeway. (Ord. 3350 §1, 1969; Ord. 2713 §1(part), 1959; prior <strong>Code</strong><br />

§31.64.)<br />
