4.37.170 Severability.<br />

If any section, subsection, paragraph, subparagraph, sentence, clause or phrase <strong>of</strong> this chapter, or the application<br />

there<strong>of</strong> to any person or circumstances, is for any reason held invalid, the validity <strong>of</strong> the remainder <strong>of</strong> this Chapter, or<br />

the application <strong>of</strong> such provision to other persons or circumstances, shall not be affected thereby. The <strong>City</strong> Council<br />

declares that it would have adopted this Chapter, and each section, subsection, paragraph, subparagraph, sentence,<br />

clause or phrase there<strong>of</strong> irrespective <strong>of</strong> the fact that one (1) or more sections, subsections, paragraphs, subparagraphs,<br />

sentences, clauses or phrases, or the application there<strong>of</strong> to any person or circumstances, is held invalid. (Ord. 4719,<br />

1991.)<br />

4.37.180 Suspension <strong>of</strong> Collection <strong>of</strong> the 1971 Parking and Business Improvement Area Tax.<br />

Except for the collection <strong>of</strong> delinquent taxes under Chapter 4.36, collection <strong>of</strong> the taxes imposed by Chapter 4.36<br />

shall be suspended after the ordinance creating the Downtown Parking and Business Improvement Assessment Area<br />

<strong>of</strong> 1991 described in this Chapter 4.37 is effective and the <strong>City</strong> Council has adopted its first annual PBIA assessment<br />

resolution levying the PBIA Benefit Assessment, and for as long as such assessments can lawfully be collected in the<br />

Downtown Parking and Business Improvement Assessment Area <strong>of</strong> 1991. If the collection <strong>of</strong> such assessments is<br />

enjoined or determined to be invalid by any court <strong>of</strong> competent jurisdiction, said suspension <strong>of</strong> taxes collected under<br />

Chapter 4.36 shall automatically terminate. (Ord. 4719, 1991.)<br />
