EE. POTW or PUBLICLY OWNED TREATMENT WORKS. All collection, transport and treatment<br />

facilities used by the Agency for the collection, treatment or disposal <strong>of</strong> Wastewater.<br />

FF. PREMISES. Any land, including any improvements or structures thereon, which is owned, used, occupied,<br />

leased or operated by a User and from or on which Discharges occur or Wastewater is created.<br />

GG. PUBLIC WORKS DIRECTOR. The Director <strong>of</strong> Public Works for the <strong>City</strong> <strong>of</strong> <strong>Santa</strong> <strong>Barbara</strong> or his or her<br />

designated representative.<br />

HH. SIGNIFICANT INDUSTRIAL USER. Any User who discharges more than 10,000 gpd, or is regulated<br />

under federal categorical standards, or has the capability to affect deleteriously the POTW, or contributes greater than<br />

5% <strong>of</strong> the POTW's hydraulic or organic loading at any time.<br />

II. SIGNIFICANT NON-COMPLIANCE. Any action or conduct by a User which constitutes a violation <strong>of</strong><br />

any Applicable Regulation and which consists <strong>of</strong> one or more <strong>of</strong> the following:<br />

1. Sixty-six percent (66%) or more <strong>of</strong> all <strong>of</strong> the Discharge samples collected during a six-month period<br />

exceed the maximum or average limit for the same pollutant as such limit is provided for by an Applicable<br />

Regulation;<br />

2. Thirty-three percent (33%) or more <strong>of</strong> all <strong>of</strong> the Discharge samples collected during a six-month period<br />

contain the same pollutant in a concentration that exceeds the TRC for that pollutant;<br />

3. Any other violation <strong>of</strong> a pretreatment effluent limit (daily maximum or longer term average) which,<br />

alone or in combination with other Discharges, causes Interference or Pass Through, or endangers the health <strong>of</strong><br />

POTW personnel or the general public;<br />

4. Any discharge <strong>of</strong> a pollutant that causes imminent danger to human health or welfare or to the<br />

environment and results in the POTW's exercise <strong>of</strong> its emergency authority to halt or prevent the Discharge;<br />

5. Any violation ninety (90) days or more after the compliance schedule date <strong>of</strong> a compliance schedule<br />

milestone, which milestone is contained in a local control mechanism or enforcement order for starting construction<br />

or completing construction or attaining final compliance;<br />

6. Any failure to provide to the Agency within thirty (30) days <strong>of</strong> the date required any report required by<br />

any Applicable Regulation, including but not limited to, any baseline monitoring, 90-day compliance, or periodic<br />

self-monitoring reports, and any report describing or discussing compliance with compliance schedules;<br />

7. Any failure to accurately report non-compliance.<br />

JJ. SIGNIFICANT VIOLATION. Except as this term may otherwise be defined by EPA or Title 40 <strong>of</strong> the<br />

<strong>Code</strong> <strong>of</strong> Federal Regulations, any act or conduct by a User which constitutes a violation <strong>of</strong> any Applicable Regulation<br />

and which:<br />

1. Remains uncorrected forty-five (45) days after notification <strong>of</strong> non-compliance with any Applicable<br />

Regulation;<br />

2. Is part <strong>of</strong> a Pattern <strong>of</strong> Non-Compliance with any Applicable Regulation;<br />

3. Occurs as a result <strong>of</strong> or in conjunction with a failure accurately to report non-compliance with any<br />

Applicable Regulation; or<br />

4. Results in the POTW exercising its emergency authority under 40 CFR 403.8(f)(1)(vi)(B).<br />

KK. STATE. The State <strong>of</strong> California, including any department or agency there<strong>of</strong>.<br />

LL. TRC or TECHNICAL REVIEW CRITERIA. (a) 1.4 times the applicable limit for BOD, TSS, oil, grease<br />

and fats or (b) 1.2 times the applicable limit for any other Non-Compatible Pollutant, except pH.<br />

MM. UNPOLLUTED WATER. Water to which no constituent has been added, either intentionally or<br />

accidentally, which would render such water unacceptable to the Agency having jurisdiction there<strong>of</strong> for disposal to<br />

storm or natural drainages or directly to surface waters.<br />

NN. USER. Any Person who causes or permits a Discharge from any Premises used, in whole or in part and<br />

whether intermittently or continuously, for any commercial, industrial, manufacturing, or institutional purpose.<br />

OO. USER CLASSIFICATION. A classification <strong>of</strong> User based on the 1972 edition <strong>of</strong> the Standard Industrial<br />

Classification (SIC) Manual prepared by the Executive Office <strong>of</strong> Management and Budget.<br />

PP. WASTE. Sewage and any and all other Waste substances, liquid, solid, gaseous or radioactive, associated<br />

with human habitation, or <strong>of</strong> human or animal origin, or from any producing, manufacturing or processing operation<br />

<strong>of</strong> whatever nature, including such Waste placed within containers <strong>of</strong> whatever nature prior to, and for purposes <strong>of</strong>,<br />

disposal.<br />

QQ. WASTEWATER. Waste and water, whether treated or untreated, discharged into or permitted to enter a<br />

Community Sewer.<br />

RR. WASTEWATER CONSTITUENTS AND CHARACTERISTICS. The individual chemical, physical,<br />

bacteriological and radiological parameters, including volume and flow rate and such other parameters, that serve to<br />

define, classify or measure the contents, quality, quantity and strength <strong>of</strong> Wastewater.<br />

SS. WATERS OF THE STATE. Any water, surface or underground, including saline waters within the<br />

boundaries <strong>of</strong> the State. (Ord. 5340, 2004; Ord. 4589, 1989; Ord. 4269, 1984; Ord. 3883 §1, 1977.)<br />
