MOBILEHOME AND PERMANENT RECREATIONAL VEHICLE PARK<br />

28.78.010 Permit Required for Conversion <strong>of</strong> Mobilehome and Permanent Recreational Vehicle Parks;<br />

Conversion Defined.<br />

A. PERMIT REQUIRED. No person, firm, corporation, partnership or other entity shall convert the use <strong>of</strong> any<br />

existing mobilehome park or permanent recreational vehicle park without first having said conversion tentatively<br />

approved by the Planning Commission, or the <strong>City</strong> Council on appeal, and having been issued a conversion permit by<br />

the Chief <strong>of</strong> Building and Zoning.<br />

B. CONVERSION DEFINED. For purposes <strong>of</strong> this Chapter, "conversion" shall mean use <strong>of</strong> a mobilehome or<br />

permanent recreational vehicle park or a portion <strong>of</strong> a mobilehome or permanent recreational vehicle park for a<br />

purpose other than the rental, or the holding out for rent, <strong>of</strong> two (2) or more mobilehome or recreational vehicle<br />

spaces to accommodate mobilehomes or recreational vehicles and shall not mean the adoption, amendment or repeal<br />

<strong>of</strong> a park rule or regulation. "Conversion" may affect an entire park or any portion there<strong>of</strong>, and such "conversion"<br />

shall include, but is not limited to, a conversion <strong>of</strong> a park or any portion there<strong>of</strong> to a condominium, stock cooperative,<br />

residential development, commercial use, <strong>of</strong>fice use, manufacturing use or vacant land. Any conversion to<br />

condominiums shall be subject to Sections 28.88.050, 28.88.060, 28.88.070, 28.88.080, 28.88.090 and Section<br />

28.88.100 <strong>of</strong> this Title, in addition to the provisions <strong>of</strong> this Chapter. For the purposes <strong>of</strong> this Chapter, condominiums<br />

shall be deemed to include community apartments and stock cooperatives. (Ord. 4269, 1984.)<br />

28.78.020 Issuance <strong>of</strong> Conversion Permits.<br />

A. CRITERIA. The Chief <strong>of</strong> Building and Zoning shall issue a conversion permit when he determines that:<br />

1. The applicant has complied with all the applicable <strong>City</strong>, state and federal laws and regulations in effect at<br />

the time that the conversion was approved; and<br />

2. The applicant has complied with all <strong>of</strong> the conditions <strong>of</strong> approval.<br />

B. REVOCATION. Once issued, the conversion permit may be revoked if the applicant or his successors in<br />

interest fails to comply with the conditions <strong>of</strong> approval or other applicable laws.<br />

C. EXPIRATION. For a conversion involving a subdivision, a tentative conversion approval shall expire when<br />

the tentative subdivision map expires. For a conversion not involving a subdivision a tentative approval shall expire<br />

after the same period <strong>of</strong> time as if it were a project requiring a tentative subdivision map. (Ord. 4269, 1984.)<br />

28.78.030 Physical Standards for Conversion <strong>of</strong> Mobilehome and Permanent Recreational Vehicle Parks to<br />

Condominiums or Overnight Recreational Vehicle Parks.<br />

A. STANDARDS. In order to convert the use <strong>of</strong> a mobilehome or permanent recreational vehicle park to<br />

mobilehome or recreational vehicle condominiums, said park shall be brought up to the standards for construction <strong>of</strong><br />

new mobilehome or permanent recreational vehicle parks as established in Section 28.94.040 and 28.94.045 <strong>of</strong> this<br />

<strong>Code</strong>. In cases where (i) the applicant can demonstrate that the standards cannot or should not reasonably be met, and<br />

(ii) 75% <strong>of</strong> the current residents <strong>of</strong> an applicant's park have expressed a written intent to purchase the park from the<br />

applicant, said standards may be waived or modified by the Planning Commission.<br />

B. CONVERSION. In order to convert the use <strong>of</strong> a mobilehome or permanent recreational vehicle park to an<br />

overnight recreational vehicle park, said overnight recreational vehicle park shall meet all standards required by<br />

Section 28.94.050 <strong>of</strong> this <strong>Code</strong>. (Ord. 4269, 1984.)<br />
