GARDEN APARTMENT DEVELOPMENTS<br />

28.30.005 Legislative Intent.<br />

Now, therefore, it is declared to be the legislative intent <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Santa</strong> <strong>Barbara</strong> to provide for greater flexibility in<br />

the development <strong>of</strong> residential properties and for greater amenities and open space related thereto when in the public<br />

interest and welfare; to encourage a more creative approach to the development <strong>of</strong> land; to protect and enhance property<br />

values and to provide more desirable spatial relationships between buildings and structures on the land than would be<br />

possible under strict adherence to ordinance requirements <strong>of</strong> the basic zone; and to encourage the preservation and<br />

enhancement <strong>of</strong> natural beauty and the provision <strong>of</strong> landscaped open spaces for visual and recreational enjoyment.<br />

As a further declaration <strong>of</strong> the legislative intent <strong>of</strong> this chapter, it is hereby declared that the provisions hereinafter<br />

contained for the computation <strong>of</strong> the allowable maximum number <strong>of</strong> dwelling units shall not be used as a means <strong>of</strong><br />

creating density higher than that allowed under Chapter 28.18, nor a density higher than would be possible by way <strong>of</strong> the<br />

usual subdivision procedure.<br />

Garden apartment developments shall provide for close visual and physical relationship between dwelling units and the<br />

landscaped open areas which must dominate the site development, such landscaped open areas to include substantial<br />

usable areas for passive and/or active recreational use; from public view the development shall present a landscaped open<br />

space effect; parking areas and building masses shall not dominate the scene. (Ord. 3710, 1974; Ord. 2585, 1957.)<br />

28.30.032 Where Permitted.<br />

Garden apartment developments may be permitted in R-2 Two-family Residence Zones upon the issuance <strong>of</strong> a<br />

conditional use permit pursuant to Chapter 28.94 <strong>of</strong> this title. (Ord. 3710, 1974; Ord. 2585, 1957.)<br />

28.30.060 Setbacks.<br />

A. FRONT SETBACK. There shall be a front setback <strong>of</strong> not less than thirty feet (30').<br />

B. INTERIOR SETBACK. There shall be interior setbacks <strong>of</strong> not less than thirty feet (30'). (Ord. 5459, 2008; Ord.<br />

3710, 1974; Ord. 3587, 1973.)<br />

28.30.070 Distance Between Buildings.<br />

No building containing dwelling units shall be located closer to another building containing dwelling units than onehalf<br />

(1/2) the sum <strong>of</strong> the heights <strong>of</strong> both such buildings, and in no case less than fifteen feet (15'). (Ord. 3710, 1974; Ord.<br />

2585, 1957.)<br />

28.30.080 Lot Area Requirements.<br />

Each garden apartment development hereafter approved shall be located on a site <strong>of</strong> not less than twenty-five thousand<br />

(25,000) square feet <strong>of</strong> net area.<br />

There shall be a minimum <strong>of</strong> three thousand (3,000) square feet <strong>of</strong> lot area per dwelling unit. (Ord. 3710, 1974; Ord.<br />

2585, 1957.)<br />

28.30.090 Units Per Building.<br />

No building shall contain more than eight (8) dwelling units. (Ord. 3710, 1974; Ord. 2585, 1957.)<br />

28.30.100 Off-street Parking.<br />

Off-street parking shall be provided as required in Chapter 28.90 <strong>of</strong> this title. (Ord. 3710, 1974; Ord. 2585, 1957.)<br />

28.30.110 Signs.<br />

Signs shall be permitted in this zone only as provided in the Sign Ordinance <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Santa</strong> <strong>Barbara</strong>. (Ord. 3710,<br />
