For the purpose <strong>of</strong> this chapter:<br />

A) "Commercial or business property" means all property excepting property containing three (3) residential<br />

units or less, which property is used solely for residential purposes whether such units be in the same or different<br />

structures.<br />

B) "Contractor" means a contractor licensed in accordance with Chapter 9 <strong>of</strong> Division 3 <strong>of</strong> the Business and<br />

Pr<strong>of</strong>essions <strong>Code</strong> (Contractors License Law) <strong>of</strong> the State <strong>of</strong> California.<br />

C) "Permittee" means a person who obtained a permit authorized by this chapter.<br />

D) "Public Works Director" means the Public Works Director <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Santa</strong> <strong>Barbara</strong> or a person<br />

authorized by him.<br />

E) "Residential property" means all property other than commercial or business property.<br />

F) "Working day" means a day that <strong>City</strong> <strong>of</strong>fices are open for business. (Ord. 4090, 1980; prior <strong>Code</strong> 39.17.)<br />

22.60.020 Permit Required, Issuance, Time for Completion.<br />

A. Permit. No person shall construct, reconstruct, repair, remove or replace any pavement, sidewalk, driveway,<br />

curb, gutter or any other improvements in any public street, alley, court, right-<strong>of</strong>-way, or public place within the <strong>City</strong>,<br />

or commence any excavation therein, or construct any improvements on public property, easements or rights-<strong>of</strong>-way<br />

owned or to be conveyed to the <strong>City</strong> without first making application for and obtaining a written permit from the<br />

Public Works Director to perform such work.<br />

B. Emergency Repairs. It shall be unlawful for any person to commence any work for which a permit is<br />

required by provision <strong>of</strong> this chapter until a permit for the subject work has been issued by the Public Works<br />

Department, except in those cases where emergency repairs <strong>of</strong> utilities or other excavation work done for the<br />

protection <strong>of</strong> the public safety require street excavation prior to issuance <strong>of</strong> a permit. This exception shall not apply to<br />

any such work done for the protection <strong>of</strong> public safety unless the person who performs such repairs or work files a<br />

complete application for a permit, including the required fees and charges, with the Public Works Department within<br />

three (3) working days after commencing such repairs or work and obtains the required permit.<br />
