REVERSIONS TO ACREAGE<br />

27.12.030 Reversion <strong>of</strong> Contiguous Parcels<br />

Under the Same Ownership.<br />

Subdivided land may be reverted to acreage pursuant to the provisions <strong>of</strong> Article 1, Chapter 6 <strong>of</strong> the Subdivision<br />

Map Act. (Ord. 3790 §1, 1975.)<br />

27.12.020 Initiation.<br />

Proceedings for reversion to acreage may be initiated by the <strong>City</strong> Council on its own motion or by petition <strong>of</strong> all<br />

the owners <strong>of</strong> record <strong>of</strong> the real property within the subdivision. (Ord. 3790 §1, 1975.)<br />

27.12.030 Reversion <strong>of</strong> Contiguous Parcels Under the Same Ownership.<br />

A. PARCEL MAP, WAIVER OF TENTATIVE MAP PROCEDURE. Four (4) or less contiguous parcels under<br />

the same ownership may be reverted to acreage by the submission <strong>of</strong> a parcel map to the <strong>City</strong> Council for approval.<br />

Any map so submitted shall be accompanied by evidence <strong>of</strong> title and non-use or lack <strong>of</strong> necessity <strong>of</strong> any streets or<br />

easements which are to be vacated or abandoned. Any streets or easements to be left in effect after the reversion shall<br />

be adequately delineated on the map. Any tentative map procedures or requirements for a parcel map used solely to<br />

complete a reversion to acreage are waived automatically upon approval <strong>of</strong> the reversion by the <strong>City</strong> Council unless<br />

the <strong>City</strong> Council expressly conditions the reversion upon compliance with all or a part <strong>of</strong> those procedures and<br />

requirements.<br />

B. RECORDATION OF PARCEL MAP. After approval <strong>of</strong> the reversion by the <strong>City</strong> Council, the map shall be<br />

delivered to the County Recorder. The recording <strong>of</strong> the map shall constitute legal reversion to acreage <strong>of</strong> the land<br />

affected thereby, and shall constitute abandonment <strong>of</strong> all streets and easements not shown on the map. The recording<br />

<strong>of</strong> the map shall also constitute a merger <strong>of</strong> the separate parcels into one (1) parcel for the purposes <strong>of</strong> this Title and<br />

the Subdivision Map Act. (Ord. 4412, 1986; Ord. 3790 §1, 1975.)<br />

This Chapter shall apply to common interest developments that have at least one residential unit. (Ord. 5380,<br />

27.13.020 Definition - Residential Condominium.<br />

For the purposes <strong>of</strong> this Chapter, condominium shall include any residential condominium, community apartment<br />

or stock cooperative. (Ord. 4058, 1980.)<br />
