HAZARDOUS WASTE GENERATORS<br />

22.06.040 Applicability.<br />

This Chapter shall be referred to as the Hazardous Waste Generators Ordinance <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Santa</strong> <strong>Barbara</strong>.<br />

22.06.020 Purpose and Intent.<br />

The purpose <strong>of</strong> this Chapter is to implement certain policies <strong>of</strong> the Hazardous Waste Management Plan adopted in<br />

Chapter 22.05 <strong>of</strong> this <strong>Code</strong> by requiring hazardous waste generators to incorporate waste minimization and<br />

emergency response considerations into their uses and developments. The intent is to require generators to submit a<br />

Waste Minimization Plan to the <strong>Santa</strong> <strong>Barbara</strong> County Department <strong>of</strong> Environmental Health Services or successor<br />

agency and incorporate waste minimization techniques where technically and economically feasible, comply with the<br />

County Department <strong>of</strong> Environmental Health Services' Generator Permit Program and prepare an emergency response<br />

plan where required by Chapter 6.95 (commencing with Section 25500) <strong>of</strong> the California Health and Safety <strong>Code</strong>.<br />

22.06.030 Definitions.<br />

Whenever in this Chapter the following terms are used, they shall be construed to have the meaning(s) ascribed to<br />

them in this section unless it is apparent from the context in which they appear that some other meaning is intended.<br />

A. Business Plan. A "Business Plan" means that plan which each business with specified quantities <strong>of</strong><br />

hazardous materials (including wastes) must prepare under Chapter 6.95 <strong>of</strong> the California Health and Safety <strong>Code</strong>.<br />

The business plan must include an inventory <strong>of</strong> hazardous materials on site, an emergency response plan and<br />

employee training procedures.<br />

B. Generator. "Generator" means the person, business or facility who, by nature <strong>of</strong> ownership, management or<br />

control is responsible for causing or allowing to be caused the creation <strong>of</strong> hazardous waste.<br />

C. Generator Permit. "Generator Permit" means the annual permit to operate required by State law <strong>of</strong> all<br />

generators <strong>of</strong> hazardous waste. Generator Permits must be obtained from the <strong>Santa</strong> <strong>Barbara</strong> County Department <strong>of</strong><br />

Environmental Health Services, or successor agency.<br />

D. Hazardous Waste. "Hazardous Waste" means a waste, or combination <strong>of</strong> wastes, which because <strong>of</strong> the<br />

quantity, concentration or physical and chemical characteristics may either a) cause or significantly contribute to an<br />

increase in mortality or an increase in serious irreversible or incapacitating reversible illness, or b) pose a substantial<br />

present or potential hazard to human health or the environment when improperly treated, stored, transported, disposed<br />

or otherwise managed. Hazardous waste also includes those materials described in Title 22, Division 4.5, Chapter 11,<br />

California <strong>Code</strong> <strong>of</strong> Regulations (CCR).<br />

E. Waste Minimization. "Waste Minimization" means the reduction, to the maximum extent feasible, <strong>of</strong><br />

hazardous waste that is generated or subsequently stored, treated or disposed <strong>of</strong>. Waste minimization is a reduction in<br />

the total volume or quantity <strong>of</strong> hazardous waste and minimizes the present and future threat to human health and the<br />

environment. As used in the Hazardous Waste Management Plan and this <strong>Code</strong>, waste minimization includes source<br />

reduction, recycling and on site treatment <strong>of</strong> hazardous wastes. (Ord. 4825, 1993.)<br />

22.06.040 Applicability.<br />

The provisions <strong>of</strong> this Chapter apply to any activity within the <strong>City</strong> <strong>of</strong> <strong>Santa</strong> <strong>Barbara</strong> for which a Generator Permit<br />

is required that is undertaken by a person or business who is or will be a generator <strong>of</strong> hazardous waste. (Ord. 4825,<br />

1993.)<br />

22.06.050 Requirements.<br />

A. As part <strong>of</strong> the application to the County Department <strong>of</strong> Environmental Health Services for a Generator<br />

Permit, the applicant shall submit a Waste Minimization Plan.<br />

B. All new or modified Generator Permits shall incorporate waste minimization techniques to the maximum<br />

extent that is economically and technically feasible.<br />
