10. Is at least one hundred (100) feet from another newsrack containing the same written material, except<br />

where the locations are separated by a street or corner, or the owner <strong>of</strong> the newsrack established to the satisfaction <strong>of</strong><br />

the Public Works Director that (i) there is insufficient room in one newsrack for the publications which may be sold<br />

in one day, or (ii) it publishes more than one edition <strong>of</strong> the publication for sale at the same time.<br />

11. Does not face another newsrack across the width <strong>of</strong> a public sidewalk or pedestrian way.<br />

12. If privately owned, has been approved by the owner or person in possession <strong>of</strong> the property.<br />

13. Will not hinder access to entrances to commercial property or commercial displays such as store<br />

windows.<br />

14. If located within a Landmarks District, will not have an adverse impact on access to, or views <strong>of</strong>,<br />

designated landmarks, structures <strong>of</strong> merit, or structures <strong>of</strong> interest to tourists.<br />

15. If located in the Beachfront Area, is no more than forty-eight (48) inches in height measured from the<br />

sidewalk to the top <strong>of</strong> the newsrack.<br />

16. If eight or more newsracks are placed at a single location, they shall be grouped in eights and each group<br />

shall be separated from the next group by at least thirty six (36) inches.<br />

17. Is not a sidewalk improved with decorative tile or other distinctive surface, except as permitted by the<br />

Public Works Director.<br />

The distances specified in this Subsection A may be reduced by the Public Works Director provided the placement <strong>of</strong><br />

the newsrack is accomplished in a manner consistent with the purposes <strong>of</strong> this Chapter.<br />

B. APPEARANCE.<br />

1. Voluntary Guidelines. As to any newsrack in place as <strong>of</strong> the effective date <strong>of</strong> the 1988 amendments to<br />

this Chapter, at any location within a Landmarks District occupied by four or more newsracks, all newsracks should<br />

be similar in appearance and, where there are groupings <strong>of</strong> four newsracks, each grouping should be mounted on a<br />

single modular support post. The standards set forth in this paragraph are voluntary, not mandatory.<br />

2. Mandatory Regulations.<br />

a. As to any newsrack installed or placed at any location within a Landmarks District occupied by four<br />

or more newsracks after the effective date <strong>of</strong> the ordinance enacting the 1988 amendments to this Chapter, the<br />

newsrack shall be similar in appearance to the predominant style and model <strong>of</strong> newsrack at that location. If there is<br />

no predominant style or model <strong>of</strong> newsrack at that location, the newsrack shall be a model approved for that location<br />

by the Public Works Director.<br />

b. Each newsrack shall be maintained in a clean and neat condition and in good repair at all times.<br />

Specifically, but without limiting the generality <strong>of</strong> the foregoing, each newsrack shall be serviced and maintained so<br />

that:<br />

(1) It is free <strong>of</strong> dirt and grease.<br />

(2) It is free <strong>of</strong> chipped, faded, peeling and cracked paint in the visible painted areas there<strong>of</strong>.<br />

(3) It is free <strong>of</strong> rust and corrosion in the visible unpainted metal areas thereon.<br />

(4) The clear plastic or glass parts there<strong>of</strong>, if any, through which the publications therein are<br />

viewed are unbroken and free <strong>of</strong> cracks, dents, blemishes and discoloration.<br />

(5) The paper or cardboard parts or inserts there<strong>of</strong> are free <strong>of</strong> tears, peeling or fading.<br />

(6) The structural parts there<strong>of</strong> are not broken or misshapen.<br />

c. Any newsrack installed, placed or replaced after the effective date <strong>of</strong> the first amendments to this<br />

Chapter adopted in 1990 shall comply with the following appearance standards:<br />

(1) All opaque surfaces shall be painted a woodgrain brown tone, or a substantially similar<br />

color approved by the Public Works Director.<br />

(2) The mount shall be painted gloss black.<br />

d. A newsrack installed or placed at any location within a Landmarks District shall carry no advertising<br />

except the name <strong>of</strong> the newspaper or periodical being dispensed on the bottom one third (1/3) <strong>of</strong> the plastic hood or, if<br />

there is no plastic hood on the newsrack, the name shown at not more than two locations on the newsrack.<br />

C. IDENTIFICATION INFORMATION. The name, address and telephone number <strong>of</strong> a responsible person<br />

who may be contacted at any time concerning the newsrack shall be displayed on the hood <strong>of</strong> the newsrack (or, if<br />

there is no hood, on the top <strong>of</strong> the newsrack) in such a manner as to be readily visible to and readable by a prospective<br />

customer.<br />

D. MODE OF ATTACHMENT AND REMOVAL. Newsracks shall be attached to or removed from the<br />

sidewalk or other improvement in accordance with specifications provided by the Public Works Director. (Ord. 4662,<br />
