L. LIMOUSINE TAXI. Any vehicle <strong>of</strong> distinctive color or insignia which provides taxi service, is equipped<br />

with a taximeter, and is over 18 feet in length.<br />

M. MANIFEST. A daily record prepared by a taxi driver <strong>of</strong> all paid and non-paid trips.<br />

N. OWNER. Any person, firm, corporation or other form <strong>of</strong> business organization having proprietary control,<br />

or right to proprietary control, <strong>of</strong> any vehicle engaged in the business <strong>of</strong> providing paratransit service, as defined<br />

herein.<br />

O. OWNER'S PERMIT. A certificate which authorizes operation <strong>of</strong> a paratransit service in the <strong>City</strong> and which<br />

is issued to any person, firm, corporation or other form <strong>of</strong> business organization having proprietary control <strong>of</strong> any<br />

vehicle engaged in the business <strong>of</strong> providing paratransit services.<br />

P. PARATRANSIT SERVICE. Taxi, shared-ride, limousine and other transportation services for which a fee is<br />

charged and which does not involve self-driving.<br />

Q. PERSON. Both singular and plural shall mean and include any individual, firm, corporation, association,<br />

partnership or society, exclusive <strong>of</strong> public agencies.<br />

R. PREMIUM TAXI SERVICE. Exclusive use <strong>of</strong> a taxi by one passenger at a time, with the time <strong>of</strong> pickup and<br />

origin and destination points specified by the passenger.<br />

S. SHARED TAXI SERVICE. Nonexclusive use <strong>of</strong> a taxi vehicle by two or more passengers traveling<br />

between different origin and destination points.<br />

T. TAXI. Any vehicle <strong>of</strong> distinctive color or insignia which provides taxi service and is equipped with a<br />

taximeter.<br />

U. TAXIMETER. Any instrument or device in a vehicle which registers and calculates at pre-determined rates<br />

the charge for hire <strong>of</strong> such vehicle in dollars and cents in accordance with the distance traveled and/or time elapsed.<br />

V. TAXI SERVICE. Any public passenger transportation service available for hire on call or demand over the<br />

public streets <strong>of</strong> the city, in a vehicle <strong>of</strong> distinctive color or insignia, operated by a driver licensed hereunder, and<br />

which is equipped with a taximeter. Such service shall not be provided over a defined route but between such points<br />

and over such routes as may be directed by the passenger or person hiring the same, and irrespective <strong>of</strong> whether the<br />

operations extend beyond the boundary <strong>of</strong> the city.<br />

W. TAXI STAND. Any portion <strong>of</strong> a street designed for the exclusive use <strong>of</strong> taxis while waiting for<br />

employment.<br />

X. WAITING TIME. Time spent while a taxi is waiting and available to a passenger beginning 5 minutes after<br />

the time <strong>of</strong> arrival at the place to which it has been called; or time spent at the special instance and request <strong>of</strong> a<br />

passenger after such passenger has first engaged and entered a taxi to make a trip. (Ord. 5360, 2005; Ord. 5254,<br />

2002; Ord. 4206, 1983.)<br />

5.29.015 Exemption.<br />

A vehicle is exempt from this Chapter if it is:<br />

A. licensed and regulated by the California Public Utilities Commission or<br />

B. is operated by a governmental entity. (Ord. 4206, 1983.)<br />

5.29.020 Permit Required.<br />

It shall be unlawful to operate any paratransit service within the <strong>City</strong> without first having obtained an owner's<br />

permit from the <strong>City</strong>. (Ord. 5360, 2005; Ord. 4206, 1983.)<br />

5.29.025 Owner's Permit Application.<br />

An applicant (or authorized agent) for an owner's permit shall file with the Chief <strong>of</strong> Police a sworn application for<br />

such a permit stating the following information:<br />

A. The full name and the home and business address <strong>of</strong> the applicant or, if the applicant is a corporation, a<br />

certified copy <strong>of</strong> the Articles <strong>of</strong> Incorporation, the names and business addresses <strong>of</strong> all <strong>of</strong>ficers, directors and<br />

stockholders owning or controlling 10% or more <strong>of</strong> the stock <strong>of</strong> such corporation and the percentage <strong>of</strong> ownership <strong>of</strong><br />

each <strong>of</strong> said stockholders. If the applicant is a partnership, the application shall include a copy <strong>of</strong> the applicant’s<br />

certificate or statement <strong>of</strong> partnership and a list <strong>of</strong> all general and/or limited partners <strong>of</strong> the applicant. If the applicant<br />

is a limited liability company, the application shall include a certified copy <strong>of</strong> the applicant’s articles <strong>of</strong> organization<br />

and a list <strong>of</strong> all managers and members <strong>of</strong> the applicant.<br />

B. The trade name(s), if any, and the telephone number(s) under which the applicant does or proposes to do<br />

business.<br />

C. A <strong>City</strong> certificate <strong>of</strong> insurance establishing compliance with Section 5.29.310 <strong>of</strong> this <strong>Code</strong> and pro<strong>of</strong> that all<br />

required insurance policies have been paid for thirty (30) days in advance.<br />

D. The number <strong>of</strong> vehicles actually owned and/or the number <strong>of</strong> vehicles proposed to be operated by the<br />

applicant on the date <strong>of</strong> application.<br />

E. The seating capacity and design <strong>of</strong> the vehicle(s) and the registered and legal owner <strong>of</strong> each and every<br />

vehicle.<br />

F. The character and location <strong>of</strong> maintenance and administrative facilities to be used, if any.<br />

G. A description <strong>of</strong> the communications systems to be used.<br />
