After receiving such report and recommendation, the <strong>City</strong> Council shall consider the zoning classification to be<br />

applied upon annexation to property to be annexed. The <strong>City</strong> Council may include any such zone consideration<br />

within any notice <strong>of</strong> hearing concerning the annexation <strong>of</strong> the property involved, and the hearing on the matter <strong>of</strong><br />

zoning may be held in conjunction with any public hearing required by law to be held by the <strong>City</strong> Council in<br />

connection with the annexation proceedings.<br />

Concurrent with or prior to final annexation <strong>of</strong> the territory, the <strong>City</strong> Council shall, by ordinance, classify the<br />

property for zoning purposes in accordance with its determination, and upon the effective date <strong>of</strong> such classification<br />

ordinance, or the annexation ordinance, whichever is the later, the zone classification shall be effective and a part <strong>of</strong><br />

the General Plan <strong>of</strong> the <strong>City</strong>.<br />

The Council may as an alternative to any <strong>of</strong> the foregoing proceedings for the zoning <strong>of</strong> annexed territory:<br />

1. Allow the same to be finally annexed without zoning the land therein, and may initiate zoning there<strong>of</strong><br />

under other provisions <strong>of</strong> this title after annexation; or<br />

2. The Council may provide by ordinance effective prior to completion <strong>of</strong> annexation proceedings upon<br />

recommendation <strong>of</strong> the Planning Commission that the territory to be annexed shall as a condition <strong>of</strong> annexation<br />

remain classified the same as it was classified or zoned as unincorporated territory where as such territory it was<br />

classified as to land use by the County <strong>of</strong> <strong>Santa</strong> <strong>Barbara</strong> pursuant to a general plan <strong>of</strong> zoning. (Ord. 3710, 1974; Ord.<br />

OCCUPANCY<br />

No vacant land shall be occupied or used, and no building hereafter erected, structurally altered or moved shall be<br />

occupied or used, until a Certificate <strong>of</strong> Occupancy shall have been issued by the Chief <strong>of</strong> Building and Zoning.<br />

1. Certificates <strong>of</strong> Occupancy for a new building, or the enlargement, alteration or moving <strong>of</strong> an existing<br />

building, shall be applied for coincidentally with the application for a building permit and shall be issued within ten<br />

(10) days after the erection or alteration <strong>of</strong> such building shall have been completed in conformity with the provisions<br />

<strong>of</strong> the ordinance.<br />

2. Certificates <strong>of</strong> Occupancy for the use <strong>of</strong> vacant land, or the change in use <strong>of</strong> land as herein provided, shall be<br />

applied for before any such land shall be occupied or used for any purpose except that <strong>of</strong> tilling the soil and the<br />

growing therein <strong>of</strong> farm, garden or orchard products, and a Certificate <strong>of</strong> Occupancy shall be issued within ten (10)<br />

days after the application has been made provided such use is in conformity with the provisions <strong>of</strong> this title.<br />

3. Certificates <strong>of</strong> Occupancy shall state that the building, or proposed use <strong>of</strong> a building or land, complies with<br />

all the building and health laws and ordinances and with the provisions <strong>of</strong> this title. A record <strong>of</strong> all certificates shall<br />

be kept on file in the Office <strong>of</strong> the Chief <strong>of</strong> Building and Zoning and copies shall be furnished on request to any<br />

person having a proprietary or tenancy interest in the building or land affected. No fee shall be charged for an<br />

original Certificate; for all other Certificates or for copies <strong>of</strong> any original Certificates there shall be a charge <strong>of</strong> two<br />

dollars ($2.00) each.<br />

4. Certificate <strong>of</strong> Occupancy for non-conforming uses existing at the time <strong>of</strong> passage <strong>of</strong> this title or any<br />

amendment thereto shall be issued by the Chief <strong>of</strong> Building and Zoning and the Certificate shall state that the use is a<br />

nonconforming use and does not conform with the provisions <strong>of</strong> this title.<br />

5. No permit for excavation for any building shall be issued before an application has been made for a<br />

Certificate <strong>of</strong> Occupancy. (Ord. 3710, 1974.)<br />
