28.54.131 Development Potential.<br />

Notwithstanding any provision <strong>of</strong> law to the contrary, no application for a land use permit for a nonresidential<br />

construction project will be accepted or approved on or after December 6, 1989 unless the project complies with the<br />

provisions outlined in General Provisions, Development Plan Approval, Section 28.87.300. (Ord. 4670, 1991.)<br />

The following regulations shall apply in the C-L Limited Commercial Zone unless otherwise provided in this<br />

chapter. (Ord. 3710, 1974; Ord. 2585, 1957.)<br />

28.57.005 Legislative Intent.<br />

The C-L Limited Commercial Zone is designed to be applied to a particular area <strong>of</strong> the <strong>City</strong> because <strong>of</strong> that area's<br />

unique characteristics and its relation to other zones and activities in the community. The land classified in this zone<br />

is located on State Street, which is described by the General Plan as being the principal street in the community<br />

reflecting the character <strong>of</strong> <strong>Santa</strong> <strong>Barbara</strong> and requiring, therefore, special treatment. State Street connects the<br />

Shoreline and Harbor areas, the Central Business District and Civic Center and the northside commercial and<br />

residential district.<br />

The particular section <strong>of</strong> State Street for which this zone is designed is located above and adjacent to the Central<br />

Business District in close proximity to residential areas. General <strong>of</strong>fice, hotel and related commercial uses are<br />

appropriate and the General Plan so indicates. Also, certain commercial activities <strong>of</strong> a low intensity nature may be<br />

compatible in the commercial community established by this zone.<br />

In all developments in this area, however, the <strong>City</strong> must exercise sufficient design, construction and operation<br />

controls to assure that the desirable characteristics <strong>of</strong> State Street in this area are maintained and enhanced and that<br />

the adjacent residential environment is protected and preserved, especially in terms <strong>of</strong> light, air and existing visual<br />

amenities. (Ord. 4005 §10, 1979; Ord. 3710, 1974; Ord. 2585, 1957.)<br />

28.57.030 Uses Permitted in the C-L Zone.<br />

A. Any use permitted in the R-O, C-O and R-4 Zones and subject to the use restrictions and limitations<br />

contained in the respective zone, except that any such use specifically mentioned hereafter shall be subject to the use<br />

restrictions <strong>of</strong> the C-L Zone.<br />

B. Any <strong>of</strong> the following uses:<br />

1. Antique shop.<br />

2. Bank.<br />

3. Barber, beauty shop, including hair stylist.<br />

4. Candy, ice cream, pastry shop.<br />

5. Caterer.<br />

6. Child Care Center.<br />

7. Delicatessen and specialty food store, including convenience grocery items.<br />

8. Drug store and pharmacy, limited to stores carrying primarily drugs, personal care and health products.<br />

9. Florist shop.<br />

10. Funeral parlor.<br />

11. Gift shop.<br />

12. Household hazardous waste collection facility, as defined in Section 28.04.405 <strong>of</strong> this Title.<br />

13. Interior decorating shop.<br />
