B. EXCEPTION. As used in this Section, the term "using electrical energy", shall not be construed to mean the<br />

storage <strong>of</strong> such energy by a person in a battery owned or possessed by him for use in an automobile or other<br />

machinery or device apart from the premises upon which the energy was received; provided, however, that the term<br />

shall include the receiving <strong>of</strong> such energy for the purpose <strong>of</strong> using it in the charging <strong>of</strong> batteries. The term does not<br />

include electricity used in water pumping by water corporations; nor shall the term include the mere receiving <strong>of</strong> such<br />

energy by an electrical corporation at a point within the <strong>City</strong> for resale. (Ord. 4289, 1984; Ord. 3927, 1977; Ord.<br />

4.24.040 Gas Tax.<br />

A. TAX IMPOSED; RATE. There is imposed a tax upon every person in the <strong>City</strong> using the <strong>City</strong> gas which is<br />

delivered through mains or pipes. The tax imposed by this Section shall be at the rate <strong>of</strong> six percent (6%) <strong>of</strong> the<br />

charges made for such gas, including minimum charges for service, and shall be paid for by the person paying for<br />

such gas.<br />

B. EXCEPTIONS. The term "charges" shall not include charges made for gas which is to be resold and<br />

delivered through mains or pipes, charges made for gas sold or used in the generation <strong>of</strong> electrical energy by a public<br />

utility or a governmental agency, and charges made by a gas public utility for gas used or consumed in the conduct <strong>of</strong><br />

the business <strong>of</strong> gas public utilities. (Ord. 4289, 1984; Ord. 3927, 1977; Ord. 3436 Section 1(part), 1970.)<br />

4.24.050 Water Tax.<br />

A. TAX IMPOSED; RATE. There is imposed a tax upon every person in the <strong>City</strong> using water which is<br />

delivered through mains or pipes. The tax imposed by this Section shall be at the rate <strong>of</strong> six percent (6%) <strong>of</strong> the<br />

charges made for such water and shall be paid by the person paying for such water.<br />

B. EXCLUSION. There shall be excluded from the base on which the tax imposed in this Section is computed,<br />

charges made for water which is to be resold and delivered through mains or pipes; and charges made by a municipal<br />

water department, public utility or a county or municipal water district for water used and consumed by such<br />

department, utility or district in the conduct <strong>of</strong> business <strong>of</strong> such department, utility or district.<br />

C. EXCLUSION. There shall also be excluded from the tax imposed by this Section 4.24.050 all water service<br />

in the <strong>City</strong> furnished by any water utility district other than the Public Works Department <strong>of</strong> the <strong>City</strong>.<br />

D. DEPOSIT OF FUNDS. Effective July 1, 2002, the proceeds <strong>of</strong> the tax imposed under this Section shall be<br />

4.24.060 Garbage Collection Tax.<br />

There is imposed a tax upon every person in the <strong>City</strong> using the service <strong>of</strong> a garbage, refuse and rubbish collection<br />

and disposal contractor or permittee authorized as such by the <strong>City</strong>, and whether such contractor or permittee be a<br />

person, firm, partnership or corporation. The tax imposed by this Section shall be at the rate <strong>of</strong> six percent (6%) <strong>of</strong><br />

the charges authorized by Section 7.16.620 <strong>of</strong> the <strong>Santa</strong> <strong>Barbara</strong> <strong>Municipal</strong> <strong>Code</strong>, 1967, or, in the event such charges<br />

be not so regulated, then upon the charges actually charged at the effective date <strong>of</strong> the ordinance codified in this<br />

Chapter. Trash collectors are exempt from the tax imposed by this Section. (Ord. 4289, 1984; Ord. 3927, 1977; Ord.<br />

4.24.070 Cable Television Tax.<br />

There is imposed a tax upon every person in the <strong>City</strong> using cable television service. The tax imposed by this<br />

Section shall be at the rate <strong>of</strong> six percent (6%) <strong>of</strong> the charges made for such service and shall be paid by the person<br />

paying for such service. (Ord. 4289, 1984; Ord. 3927, 1977; Ord. 3436 Section 1(part), 1970.)<br />

4.24.080 Exemptions.<br />

A. CONSUMER. The tax imposed by this Chapter shall not apply to any individual who used telephone,<br />

electric, gas, cable television, water services or garbage collection in or upon any premises occupied by such<br />

individual; provided the total Adjusted Gross Income <strong>of</strong> that individual, as used for purposes <strong>of</strong> the California<br />

Personal Income Tax Law, was no more than $5,330.00 for the most recent completed calendar year, and provided<br />

the combined Adjusted Gross Income <strong>of</strong> all members <strong>of</strong> the household in which such individual resided was no more<br />

than $7,990.00. The exemption amounts set forth herein shall be adjusted upwards or downwards each January 1 to<br />

reflect the percentage change in the annual average <strong>of</strong> the Consumer Price Index (All Urban Consumers, All Items-<br />

Los Angeles-Long Beach-Anaheim) for the twelve months prior to the preceding September 30. The <strong>City</strong><br />

Administrator shall compute the dollar increase or decrease annually, the result shall be rounded <strong>of</strong>f to the nearest ten<br />

dollar ($10) increment, and this adjustment shall be effective as <strong>of</strong> January 1 <strong>of</strong> each year hereafter.<br />
