D. PRECLUDED DEVELOPMENT. No application for a building permit may be approved for any project<br />

that will: (1) result in an increase <strong>of</strong> the net floor area on the lot, (2) change the location <strong>of</strong> any floor area on the<br />

second or higher story <strong>of</strong> any building on the lot, or (3) increase the height <strong>of</strong> any portion <strong>of</strong> a building on the lot to a<br />

building height <strong>of</strong> seventeen feet (17’) or higher if either <strong>of</strong> the following is true regarding the project:<br />

1. The net floor area on the lot will exceed the maximum net floor area for the lot as calculated pursuant to<br />

this Section, or<br />

2. The net floor area on the lot will exceed eighty-five percent (85%) <strong>of</strong> the maximum net floor area for the<br />

lot as calculated pursuant to this Section and any <strong>of</strong> the following conditions apply to the lot:<br />

a. The average slope <strong>of</strong> the lot or the building site (as calculated pursuant to Section 28.15.080 <strong>of</strong> this<br />

<strong>Code</strong>) is thirty percent (30%) or greater, or<br />

b. The building height <strong>of</strong> any new or existing building or structure on the lot is in excess <strong>of</strong> twenty-five<br />

feet (25’), or<br />

c. The lot is located in the Hillside Design District established in Section 22.68.080 <strong>of</strong> this <strong>Code</strong> and<br />

the application proposes five hundred (500) or more cubic yards <strong>of</strong> grading outside the footprint <strong>of</strong> the main building<br />

(soil located within five feet (5’) <strong>of</strong> an exterior wall <strong>of</strong> a main building that is excavated and recompacted shall not be<br />

included in the calculation <strong>of</strong> the volume <strong>of</strong> grading outside the building footprint). (Ord. 5518, 2010; Ord. 5444,<br />

28.15.085 Regulations for Non-Residential Buildings, Structures and Uses.<br />

A. SETBACKS. Setbacks for all buildings and structures used for nonresidential purposes shall be double the<br />

setback requirements for a dwelling as required for the zone in which such building or structure is located.<br />

B. LOT COVERAGE. Not more than twenty-five percent (25%) <strong>of</strong> the area <strong>of</strong> a lot may be covered by<br />

buildings used for nonresidential purposes.<br />

C. ARCHITECTURAL APPROVAL. All buildings used for nonresidential purposes shall be subject to the<br />

approval <strong>of</strong> the Architectural Board <strong>of</strong> Review, or the Historic Landmarks Commission if the property is located<br />

within El Pueblo Viejo Landmark District or another landmark district or if the structure is a designated <strong>City</strong><br />

Landmark.<br />

D. OTHER REQUIREMENTS. The <strong>City</strong> Council may impose other requirements as may be deemed necessary<br />

to preserve the residential character <strong>of</strong> the neighborhood, including the mailing <strong>of</strong> notices to property owners and the<br />

holding <strong>of</strong> a public hearing. (Ord. 5459, 2008; Ord. 4851, 1994; Ord. 3710, 1974; Ord. 2585, 1957.)<br />

28.15.100 Off-street Parking.<br />

Off-street parking shall be provided as required in Chapter 28.90 <strong>of</strong> this title. (Ord. 3753, 1975; Ord. 3710, 1974;<br />

Ord. 2585, 1957.)<br />

28.15.110 Signs.<br />

Signs shall be permitted in this zone only as provided in the Sign Ordinance <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Santa</strong> <strong>Barbara</strong>. (Ord.<br />
