• In cases where a minor penalty is to be given, it can be done so on the<br />

basis of a show cause notice.<br />

• Where decision for a major penalty has been taken then charge sheet is<br />

issued. Along with the charge sheet a list of documents & a list of<br />

witnesses is also attached to facilitate the DE proceedings. A reply is<br />

sought from the charged employee.<br />

• After examining the reply, if the charged employee refuses to admit<br />

the allegation then the competent authority establishes the D.E. and<br />

appoints an enquiry officer and presenting officer.<br />

• The DE has to be conducted within the time frame specified. After<br />

examining all relevant aspects the enquiry officer present the report to<br />

the Disciplinary Authority. A copy of the report is given to the<br />

charged employee and he is given an opportunity to represent his case.<br />

• The Disciplinary Authority decides the gravity of rules violated &<br />

orders the punishment accordingly.<br />

• In cases of Lokayukta/ EOW they either send the complaint for<br />

examination to the administrative department or recommend action on<br />

the basis of their own findings.<br />

2) Reply of the Show Cause served<br />

3) Order/ Date of DE instituted<br />

4) Daily order sheet & record of the proceedings<br />

5) Enquiry report<br />

6) Punishment order<br />

(C) Duties & Responsibilities:-<br />

1) Presenting officer acts on behalf of the Govt.<br />

2) The dealing Assistant will submit the report to the next higher<br />

authority for compliance.<br />
