n the last article published in Elevatori
Volume 2 of 2023, the Lifts and Escalators
Ordinance (Cap 618, ʻthe Ordinanceʼ
hereinafter) of Hong Kong was introduced.
In this article, we are going to look into
some details of the Ordinance to demonstrate
how careful and stringent the HKSAR
Government is in ensuring the safety of lift
and escalator operation.
The Ordinance applies to almost all ordinary
lifts and escalators (the installations hereinafter)
used by human passengers, including those
belonging to the government. Then, these
installations are overseen by the Electrical
and Mechanical Services Department (EMSD) of
the HKSAR Government. Responsible
persons are defined in the Ordinance, meaning
they are either the owner of an installation
or have the management or control of the
installations.
The responsible person for an installation
must ensure that the installation and all its
associated equipment or machinery are kept in a
proper state of repair and in safe working order,
and the installation is used properly or is not
used if prohibited by EMSD.
For example, the responsible person must
ensure that the installation is not used or
operated if there is no use permit in force.
In other words, if one or more of such duties
stipulated in the Ordinance cannot be complied
with, the responsible person is the frontline

In questo articolo esamineremo alcuni dettagli
dell’Ordinanza per dimostrare quanto il governo
della SAR (Regione Amministrativa Speciale) sia
attento e rigoroso nel garantire la sicurezza del
funzionamento di ascensori e scale mobili.
L’Ordinanza si applica a quasi tutti gli ascensori e
le scale mobili ordinari (di seguito ‘gli impianti’)
utilizzati da passeggeri umani, compresi quelli di
proprietà del governo. La supervisione di questi
impianti è affidata all’Electrical and Mechanical
Services Department (EMSD) del governo della
SAR. La definizione di ‘persona responsabile’
contenuta nell’ordinanza indica che si tratta del
proprietario di un impianto o di chi ha la gestione
o il controllo dell’impianto stesso. La persona
responsabile di un impianto deve garantire che
l’impianto e tutti i componenti o i macchinari ad
esso associati siano mantenuti in buono stato di
manutenzione e in condizioni di sicurezza, e che
l’impianto sia utilizzato correttamente o non sia
utilizzato se vietato dall’EMSD. Ad esempio, la
persona responsabile deve garantire che l’impianto
non venga utilizzato o messo in funzione se non
è in vigore un’autorizzazione all’uso. In altre
parole, se uno o più di questi doveri previsti
dall’Ordinanza non possono essere rispettati, la
