6.3 Brand Value Transactions and Proprietary Accounts<br />

the use of a competitive payment product for the non-payment benefit or<br />

service.<br />

A variation to this Rule appears in Chapter 12, “Europe Region <strong>Rules</strong>.”<br />

6.3.1 Proprietary Account Access<br />

The Corporation exclusively determines if a proprietary account number may<br />

be used on a Card as a BVT. A proprietary account number that the Corporation<br />

determines may be used on a Card as a BVT may have one or more of the<br />

following characteristics:<br />

1. The proprietary account number is different from the Card account number.<br />

The proprietary account number may appear on the Card face, be encoded<br />

on the Card, or be cross-referenced in the Customer or a Partner’s system.<br />

2. The proprietary account number is used in a system or network for<br />

authorization and settlement that is distinct from the Interchange System<br />

and is not used in the Interchange System.<br />

3. Any billing related to use of the proprietary account number is distinct from<br />

any billing for the Card account, whether as part of a common statement<br />

or in a separate statement.<br />

Access to a proprietary account by means of an Affinity Card Program Card<br />

or Co-brand Card Program Card is authorized only with the prior written<br />

consent of the Corporation. In addition, such a Program Card must afford the<br />

Cardholder access to the same proprietary account that the Partner previously<br />

established for the Cardholder, for payment of the same particularly defined set<br />

of transactions that were previously payable by other means. The Corporation<br />

must approve, in advance and in writing, of the locations, services, and parties<br />

for which the proprietary account access feature is available.<br />

6.3.2 Fees and Reporting Requirements<br />

From time to time, the Corporation may establish, implement, and collect fees,<br />

assessments, or both arising from or related to BVTs, proprietary accounts,<br />

or both.<br />

If a BVT involves an Affinity Card Program or a Co-brand Card Program, the<br />

Customer must separately report to the Corporation the number of Cards<br />

outstanding, the proprietary account sales volume on such Cards, and any other<br />

requested information in the form and at such times as the Corporation requires.<br />
