Service Providers<br />

7.3 General Obligations<br />

The Customer must retain all records concerning the investigation of any<br />

Service Provider with which it has entered into a Program Service agreement<br />

to receive Program Services for a minimum of two years after the date the<br />

agreement is terminated or expires.<br />

7.3.4 Disclosure of Standards<br />

Before a Customer proposes an entity to be registered as a Service Provider by<br />

the Corporation, the Customer must provide the proposed Service Provider with<br />

the Standards then in effect applicable to Service Providers and the Program<br />

Service the proposed Service Provider is expected to perform, including these<br />

Service Provider <strong>Rules</strong>. After registration, the Customer must promptly provide<br />

a Service Provider with any change to the Standards applicable to such Program<br />

Service, including any change to these Service Provider <strong>Rules</strong>.<br />

7.3.5 Customer Point of Contact<br />

A Service Provider must promptly provide a name and title of, and a telephone<br />

number for an employee of the Customer upon request by a Cardholder or a<br />

Merchant, or if the Service Provider is unable or unwilling to respond to a<br />

question to the Cardholder’s or Merchant’s satisfaction.<br />

7.3.6 Program Service for an Affiliate’s Program<br />

Program Service performed in support of an Affiliate’s Program(s) is deemed to<br />

be performed in support of the Program(s) of the Principal and Association that<br />

Sponsors the Affiliate. For that reason, an Affiliate wishing to receive Program<br />

Service from a Service Provider must obtain the prior written consent of the<br />

Affiliate’s Sponsoring Principal and Association.<br />

7.3.7 Use of the Marks<br />

A Service Provider must not use any Mark on its own behalf, whether in<br />

connection with Program Service or otherwise. A Service Provider may not<br />

suggest or in any manner create an impression that the Service Provider is a<br />

Customer or a representative of the Corporation, or that the Service Provider is<br />

anything other than a Service Provider of the Customer.<br />

The Service Provider must not create an impression that the Corporation in any<br />

way endorses the Service Provider or Program Service the Service Provider<br />

performs.<br />

The Service Provider may use one or more of the Marks in connection with the<br />

Program Service it performs, provided that:<br />

1. The Marks are used in accordance with the Standards, including all<br />

reproduction, usage and artwork Standards that may be in effect from time<br />

to time; and<br />
