Trademarks and Service Marks<br />

Compliance Zones<br />

No Customer or other Licensee or Sub-licensee or any of its affiliates may<br />

register, attempt to register, or in any way make use of any Marks or any mark<br />

or term that the Corporation in its sole discretion deems to be derivative of,<br />

similar to, dilutive of, or in any way related to a Mark on any Card, device, or<br />

other application associated with a payment service that the Corporation deems<br />

to be competitive with any Activity of the Corporation. Without limitation, the<br />

foregoing shall specifically apply to registration or use of any mark or term that<br />

incorporates, references, or otherwise could be confused or associated with any<br />

Mark currently or previously Licensed, sublicensed (to the extent sublicensing<br />

has been previously permitted), or used by a Customer, its Sub-licensees and<br />

permittees, and their respective successors or assignees (including, without<br />

limitation, by virtue of acquisition by merger or otherwise, bankruptcy or<br />

voluntary or involuntary winding-up.)<br />

4.2.13 Use of Other Acceptance Marks on Cards<br />

No acceptance mark may appear on a Card except as set forth in the Standards,<br />

including the Card Design Standards System.<br />

4.2.14 Use on Mobile Payment Devices<br />

Standards governing the use of Marks on Mobile Payment Devices are set<br />

forth in the <strong>MasterCard</strong> PayPass Branding Standards, which are incorporated<br />

into these <strong>Rules</strong> by reference. Information regarding the <strong>MasterCard</strong> PayPass<br />

Branding Standards is available by e-mail from paypass@mastercard.com.<br />

The following table identifies the noncompliance category that the Corporation<br />

has assigned to the Standards described within this chapter. These<br />

noncompliance categories are assigned for the purposes of assessments under<br />

the compliance framework, as described in Rule 3.1.2.<br />
