Europe Region <strong>Rules</strong><br />

4.1 Right to Use the Marks<br />

With respect to Cards issued in countries other than EEA countries, this Rule is<br />

a recommendation rather than a mandate.<br />

For transactions that have not been authorized by the Cardholder (for example,<br />

fraudulent Transactions), the Cardholder’s liability is zero, except as set forth<br />

below.<br />

Lost and Stolen Fraud. In the case of fraudulent Transactions resulting from<br />

loss or theft of the Card, the Cardholder’s liability is limited to a maximum<br />

of EUR 150, or to a lesser amount if so specified in applicable law or in the<br />

Cardholder agreement, for unauthorized use of the Card occurring before<br />

notification by the Cardholder of the loss or theft. If the Cardholder has acted<br />

fraudulently or with intentional or gross negligence, or has delayed unduly in<br />

notifying the Issuer or the entity specified by the Issuer of the loss or theft, the<br />

Cardholder’s liability for fraudulent Transactions resulting from loss or theft of<br />

the Card, and occurring prior to notification, is not limited.<br />

The Cardholder’s liability for fraudulent Transactions resulting from loss or theft<br />

of the Card is zero as from the time when the Cardholder has notified the Issuer<br />

or the entity specified by the Issuer of the loss or theft, or if the Issuer fails to<br />

provide means for the notification at all times of loss or theft. If the Cardholder<br />

has acted fraudulently, zero liability does not apply.<br />

Upon the Cardholder’s request, the Issuer must provide proof to the Cardholder<br />

of the notification of loss or theft of the Card during a period of 18 months<br />

after notification.<br />

4.1 Right to Use the Marks<br />

4.1.2 Protection and Registration of the Marks<br />

Rule 4.1.2 of Chapter 4, “Trademarks and Service Marks,” is modified to include<br />

the following additional Standard.<br />

<strong>MasterCard</strong> Europe sprl is the exclusive owner of the Eurocard and eurocheque<br />

marks. Customers must not, either by act or omission, do anything inconsistent<br />

with the exclusive ownership of the Eurocard or eurocheque marks, or do<br />

anything that may harm the Eurocard or eurocheque marks.<br />
