Organization of this Section<br />

The <strong>Rules</strong> in this Section 12b are variances and additions to the “global” <strong>Rules</strong><br />

that apply within the Single European Payments Area (SEPA).<br />

Definitions<br />

The defined terms provided in Chapter 12 apply to <strong>Rules</strong> in this Section 12b.<br />

Solely for the purposes of <strong>Rules</strong> in this Section 12b, the following term has<br />

the meaning set forth below.<br />

“SEPA Cards Framework (SCF)” means the SEPA Cards Framework as published<br />

by the European Payments Council, as it may be amended from time to time.<br />

2.1 Purpose of License; Eligibility<br />

2.1.1 Single European Payments Area License<br />

The following additional <strong>Rules</strong> apply within SEPA:<br />

1. Any entity that is eligible to become a Customer in one of the SEPA<br />

countries may request a SEPA License.<br />

2. The Standards applicable to other Licenses also apply to SEPA Licenses,<br />

unless otherwise provided.<br />

3. The SEPA License may be granted to a Principal or Association or an Affiliate.<br />

4. A Principal or Association holding a SEPA License may Sponsor Affiliate in<br />

one or more SEPA countries. The Affiliate(s) may receive either a SEPA<br />

License or a License.<br />

5. If a SEPA License is held by a Customer that will undertake Activities in<br />

one or more SEPA countries via separate legal entities, the separate legal<br />

entities must also sign Licenses.<br />

6. The SEPA License may cover all of the countries in SEPA. If the SEPA License<br />

will cover both Switzerland and an EEA country, any Customer legal entity<br />

or SEPA Licensee that will be active both in Switzerland and in an EEA<br />

country must be regulated both in Switzerland and in an EEA country. The<br />

holder of a SEPA License must meet all local legal requirements in each<br />

country in which it intends to undertake Activities.<br />

7. Each Principal or Association is assigned a separate ICA for each SEPA<br />

country in which it is active, must use that ICA only for its Activity in that<br />

country, and must not undertake Activity in that country before the relevant<br />

ICA has been implemented.<br />

The Principal or Association is assigned a separate BIN or BIN range for<br />

each SEPA country in which it is active, must use that BIN or BIN range<br />
