5.3 Merchant Monitoring<br />

5.2.5 Supplying Materials<br />

Each Acquirer must regularly ensure that each of its Merchants is provided with<br />

all materials necessary to effect Transactions in accordance with the Standards<br />

and to signify <strong>MasterCard</strong> acceptance. These materials may include sales slips,<br />

credit slips, terminals, authorization services, <strong>MasterCard</strong> acceptance decals,<br />

signage, and the like.<br />

5.3 Merchant Monitoring<br />

Each Acquirer must monitor on an ongoing basis the Activity and use of the<br />

Marks of each of its Merchants for the purpose of deterring fraudulent and<br />

other wrongful activity and to ensure ongoing compliance with the Standards.<br />

Minimum Merchant monitoring Standards are set forth in the Security <strong>Rules</strong><br />

and Procedures manual.<br />

5.4 Use of a Payment Facilitator<br />

The Acquirer is liable for all acts and omissions by a Payment Facilitator and<br />

any Sub-merchant.<br />

A Payment Facilitator may not be a Sub-merchant of any other Payment<br />

Facilitator, nor may a Payment Facilitator be a Payment Facilitator for another<br />

Payment Facilitator.<br />

Unless otherwise approved by the Corporation, any Sub-merchant that exceeds<br />

USD 100,000 in <strong>MasterCard</strong> and Maestro combined annual Transaction volume<br />

may not be or continue to be a Sub-merchant and must enter into a Merchant<br />

Agreement directly with a Customer.<br />

5.4.1 Responsibility for Payment Facilitator and Sub-merchant<br />

Activity<br />

The Acquirer is responsible for the Activity of the Payment Facilitator and each<br />

of its Sub-merchants, and must comply with all of the following obligations<br />

related to such Activity:<br />

1. The Payment Facilitator and each of its Sub-merchants must be located >><br />

within the Acquirer’s licensed Area of Use as described in Rule 2.3. The<br />

Acquirer must obtain an Extension of Area of Use of its license if either is<br />

located elsewhere, except as provided in Rule 2.3.1 – 5, 6, 7 and 8. The<br />

location of the Sub-merchant determines the location of a Transaction, not<br />

the location of the Payment Facilitator.<br />

2. Settlement funds accessed by the Payment Facilitator may only be used to<br />

pay Sub-merchants.<br />

3. An Acquirer may permit a Payment Facilitator to manage the following<br />

on behalf of the Acquirer:<br />
