Section 12b—SEPA <strong>Rules</strong><br />

only for its Activity in that country, and must not undertake Activity in the<br />

country before the relevant BIN or BIN range has been implemented. For<br />

Card issuance, different ranges within a BIN may be linked to ICAs assigned<br />

for different SEPA countries.<br />

8. With regard to Intracountry Transactions, the holder of a SEPA License must<br />

comply with the applicable intracountry rules and fees.<br />

3.2 Conduct of Activity<br />

3.2.6 Nondiscrimination<br />

Rule 3.2.6 of Chapter 3, “Customer Obligations,” is modified to include the<br />

following:<br />

A Customer must not, directly or indirectly, prevent or discriminate against<br />

the use of <strong>MasterCard</strong> as a brand for Intracountry Transactions or Intra-SEPA<br />

Transactions.<br />

By way of example but not limitation:<br />

1. A single certification must be valid for both intracountry and intra-SEPA use<br />

of the <strong>MasterCard</strong> payment application at the POS Terminal.<br />

2. The prevalence of any particular chip-based payment application at POS<br />

Terminal or Acquirer system level must not be mandated or implemented.<br />

3. If the <strong>MasterCard</strong> payment application is supported by both the Card and<br />

the POS Terminal, its use must not be blocked or impaired by technical<br />

or other means.<br />

4. If the <strong>MasterCard</strong> payment application is supported by both the Card and<br />

the terminal, the Cardholder must be given the opportunity to complete<br />

the Transaction with the <strong>MasterCard</strong> payment application, in an EMV<br />

environment and in all other cases where the POS Terminal is technically<br />

capable of providing that choice to the Cardholder. In an EMV environment,<br />

if the Cardholder is not able to choose a payment application, the priority<br />

order defined by the Issuer in the chip must be respected.<br />

5. Neither the Cardholder’s chosen payment application nor the Issuer’s priority<br />

order may be disregarded or overridden by technical or other means.<br />

4.2 General <strong>Rules</strong> for Use of the Marks<br />

4.2.13 Use of Other Acceptance Marks on Cards<br />

Rule 4.2.13 of Chapter 4, “Trademarks and Service Marks,” is modified to<br />

include the following:<br />

1. The Marks may co-reside on Cards with other payment scheme marks upon<br />

written agreement with the Corporation. If Cards bear multiple payment<br />
