Misconduct — bigamy<br />

No question of bigamy, when both the first and the<br />

second marriages are not proved.<br />

The petitioner, V.V. Guruvaiah, Mechanic, <strong>AP</strong>SRTC was<br />

removed from service on the ground that he had been enjoying more<br />

than one living wife, viz. Jayamma and Munamma. The petitioner<br />

contended that he married one Nagaratnamma who died and<br />

thereafter he married one Dhanavathi, who divorced him and then<br />

he married another lady by name Laxmamma and had to divorce her<br />

for her infidelity. These facts indicate that the petitioner has no doubt<br />

taken several wives one after the other but he did not have more<br />

than one wife at a time.<br />

The case against the petitioner is that the <strong>AP</strong>SRTC received<br />

a lawyer’s notice dated 1.4.1985 from V. Munamma claiming that<br />

she is the second wife of the petitioner and a son by name V.G.<br />

Somasekhara was born to them. She further claimed a sum of Rs.400<br />

per month from the salary of the petitioner on the ground that she<br />

has been deserted by the petitioner. A preliminary enquiry was<br />

conducted and a charge sheet was issued alleging, among other<br />

things, that the petitioner has committed bigamy by taking a second<br />

wife during the subsistence of his marriage with the first wife.<br />

The petitioner denied that he had any connection with<br />

Munamma and Munamma herself filed a counter affidavit denying
