(ii) It is not necessary that the public servant must<br />

receive the pecuniary advantage from third party<br />

and pass it on to the other person for his benefit.<br />

The appellant was convicted for the offence under sec. 5(2)<br />

r/w. 5(1)(d) of the Prevention of Corruption Act, 1947 (corresponding<br />

to sec. 13(2) r/w. 13(1)(d) of P.C. Act, 1988) and sentenced to one<br />

year R.I. The charge against him is that while functioning as Manager<br />

of Perambur Branch of the Syndicate Bank, obtained pecuniary<br />

advantage for others by procuring loan of Rs. 24 lakhs by furnishing<br />

bank guarantee even without deducting bank commission, without<br />

taking permission from the Head Office and without prior intimation<br />

to Head Office and the matter came up before the High Court in an<br />

appeal.<br />

The High Court held that on a plain reading of the express<br />

words “obtains for himself” used in the clause(1)(d) of Sec. 5, there<br />

cannot be any doubt that every benefit obtained by a public servant<br />

for himself, or for any other person by abusing his position as a public<br />

servant falls within the mischief of the said clause. The words “to<br />

obtain pecuniary advantage for any other person” would clearly mean<br />

that by abusing his position, he got the other person to obtain the<br />

pecuniary advantage. The words “obtain for himself” would mean<br />

that obtaining the pecuniary advantage either by himself or through<br />

somebody else for himself. Similarly, the words “to obtain for any<br />

other person” would mean, to make an effort to enable any other<br />

person to obtain the pecuniary advantage. It definitely does not mean<br />

that the public servant must receive the pecuniary advantage from<br />

third party and pass it on to the other person for his benefit. In the<br />

instant case the accused appellant while working as Manager of<br />

Syndicate Bank dishonestly in violation of the circulars and Rules<br />

and Regulations, had allowed the other accused to overdraw the<br />

loan amount to the tune of Rs. 15 lakhs without any permission or<br />

intimation to the Head Office. In order to get the loan of total amount<br />

of Rs. 24 lakhs for the other accused, he went and met the office-
