The Signal Inspector of Railway Electrification at Bhopal was<br />

issued a minor penalty charge sheet dated 13-1-1993 alleging that<br />

he caused loss of 23 rail posts. Without conducting any inquiry, the<br />

disciplinary authority, by order dated 27-10-93 imposed penalty of<br />

recovery of 50% of the cost of the rail posts.<br />

The Central Administrative Tribunal rejected the contention<br />

of the applicant that it could not be done without holding an inquiry<br />

eventhough it is a minor penalty and held that the rules do not mandate<br />

it and there was no such request made by him.<br />
