o protects the due process rights of accused persons, including<br />

the right to a presumption of innocence,<br />

the right to counsel,<br />

the right to translated documents,<br />

the right to be promptly in<strong>for</strong>med of charges,<br />

the right to be tried <strong>with</strong>out undue delay,<br />

the right to be present during trial,<br />

the right to a public trial,<br />

the right to confront witnesses and evidence,<br />

the right not to be prejudiced by choosing not to testify in one’s own defense,<br />

the right to appeal,<br />

the right to proportionate and consistent sentencing in accordance <strong>with</strong> law,<br />

and<br />

the right to a remedy <strong>for</strong> breaches of process rights. 267<br />

• Specific care should be taken to protect the rights of any <strong>for</strong>mer child combatants who might<br />

be tried <strong>for</strong> their crimes.<br />

o Neither capital punishment nor life imprisonment <strong>with</strong>out possibility of release<br />

should be imposed <strong>for</strong> offenses committed by persons below 18 years of age. 268<br />

o Children accused of crimes under international or national law allegedly committed<br />

while associated <strong>with</strong> armed <strong>for</strong>ces or armed groups are entitled to be treated in<br />

accordance <strong>with</strong> international standards <strong>for</strong> juvenile justice. 269<br />

o Individuals should not be prosecuted or punished or threatened <strong>with</strong> prosecution or<br />

punishment solely <strong>for</strong> their membership in those groups. 270<br />

o Alternatives to judicial proceedings should be sought <strong>for</strong> children. 271<br />

• <strong>The</strong> Government of Liberia should immediately pass legislation criminalizing the destruction<br />

of or tampering <strong>with</strong> evidence and otherwise obstructing the process of evidence gathering<br />

related to war crimes and human rights violations committed during the TRC mandate period<br />

from 1979 to 2003. 272<br />

• <strong>The</strong> Government of Liberia should seek assurances from key African and non-African<br />

nations that those governments will not extend any protective status, including diplomatic<br />

asylum, to persons <strong>with</strong> respect to whom there are reasons to believe they have committed a<br />

serious crime under international law. 273<br />

• A key part of the Government of Liberia’s prosecution strategy should include appropriate<br />

use of existing international accountability mechanisms, such as the International Criminal<br />

Court, African regional bodies, and national courts in other jurisdictions. Coordinated and<br />

carefully planned use of these mechanisms can be cost-effective and can help build the<br />

capacity of Liberia’s legal and judicial sectors.<br />

• In evaluating all bilateral and international options, the Government of Liberia should make<br />
