5.7.2 Role<br />

Section 35(2) <strong>of</strong> the MSA No. 32 <strong>of</strong> 2000, stipulates that the SDF, as contained in the lOP,<br />

will prevail over a plan defined in section 1 <strong>of</strong> the Physical Planning Act No. 125 <strong>of</strong> 1991<br />

alias the old guide plans. The SDF therefore has statutory power once the IDP is adopted by<br />

Council and will guide all land use management within the municipal area. The purpose <strong>of</strong><br />

the SDF is not to infringe existing land rights but to guide future land uses. No proposals in<br />

this plan create any land use right or exempt anyone from hislher obligation in terms <strong>of</strong> any<br />

other act controlling land use. Private ownership is thus retained, but in the case <strong>of</strong> vacant<br />

farms, the willing-buyer, willing-seller principle applies nationwide.<br />

5.7.3 Spatial development principles<br />

The spatial development framework (SDF) is also based on spatial development principles,<br />

which have been deriVed from the Development Framework Acts and other relevant<br />

legislations. The SDF responds to the spatial analysis and principles by identifYing a spatial<br />

structure that is designed to support the district's economy and to provide improved services<br />

to people throughout the district. A central concern <strong>of</strong>the SDF is to indicate priority areas for<br />

different types <strong>of</strong> investment by government departments and other service providers, NGOs<br />

and the private sector. The SDF has four main components:<br />

• Nodes and concentrations <strong>of</strong>settlement or economic activities.<br />

• Transport networks and communication linkages both within and beyond the<br />

district. The National Roads Agency together with the Department <strong>of</strong><br />

Transport provides funding for roads infrastructure development. This funding<br />

is however not channelled through the municipality, but is directly channelled<br />

down from provincial level to implementation in different municipalities.<br />

• Areas <strong>of</strong>particular potential or need.<br />

• <strong>Institutional</strong> arrangements for ensuring spatial integration <strong>of</strong> all development<br />

initiatives on a sustainable basis.<br />
