also. Following the enactment of this policy, Floyd stepped down as track coach and retained his<br />

principal position.<br />

In the fall of 2002, Superintendent of Schools, Mary Russ, investigated allegations of<br />

improper practices by Floyd as principal. In October, Floyd was suspended, and on November<br />

15, Floyd was notified that he had been terminated. The reasons for termination were as follows:<br />

(1) tobacco discipline policies, (2) improperly maintained records, (3) changes to academic<br />

offerings without district approval, (4) not fully disclosed track and field events, and (5) neglect<br />

of duties.<br />

During March and April 2003, a hearing officer reviewed the board’s actions. After<br />

review, the hearing officer found that Floyd’s termination was valid and proper. Floyd appealed<br />

to the Amite County Chancery Court, which reversed and reinstated Floyd. The district appealed<br />

and the court ruled in its favor. Floyd promptly filed for a writ of certiorari with the Mississippi<br />

Supreme Court.<br />

While Floyd awaited the writ of certiorari, which was denied, he filed an Equal<br />

Employment Opportunity Claim (EEOC) alleging racial discrimination. Floyd asserted that the<br />

board terminated him for working with White students on the track team during the summer<br />

months. In court, the district motioned and was granted summary judgment. Floyd’s appeal<br />

followed.<br />

Issues: (1) Did the district court err in dismissing Floyd’s Title VII claim for being<br />

untimely? (2) Was Floyd racially discriminated against for working with White students during a<br />

summer track program? (3) Did the district court err in dismissing Floyd’s other claims?<br />
