Where real property is vested in the Association in accordance with the<br />

above section, effective control may remain with the Group, Zone, Region<br />

or other part of the Association concerned.<br />

(iii) No buildings for Scout purposes shall be erected on any property unless<br />

the written consent of the Chief Executive is first obtained.<br />

(b) Any property vested in the Association may be mortgaged but only on<br />

the following conditions:<br />

Before any such mortgage commitment is entered into, the Group, Zone,<br />

Region or other part of the Association on whose behalf the property is<br />

vested in the Association, shall make written application to National Office<br />

Such application shall contain the terms of the proposed mortgage and an<br />

undertaking by the Group, Zone, Region or other part of the Association<br />

concerned to meet all the financial and other obligations of the proposed<br />

mortgage.<br />

<strong>The</strong> application will be considered by the National Office which, if it<br />

approves the application, may impose such conditions as it thinks fit.<br />

(iii) <strong>The</strong> amount of such mortgage should not exceed 60% of the value of the<br />

property.<br />

(c) (i) Any Group, Zone, Region or other part of the Association planning capital<br />

expenditure must have a sound financial proposal before commencing any<br />

work or project.<br />

(ii) <strong>The</strong> prior approval of National Office, must always be obtained to all<br />

financial obligations which could impose on the part of the Movement<br />

involved, and consequently on the Association, a liability which is $5,000 or<br />

more greater than the funds held in cash exclusively for that purpose. <strong>The</strong><br />

terms of any such obligation must be contained in a written agreement,<br />

which, if approved by National Office, must be executed by the Association<br />

under its common seal.<br />

(iii) In the absence of special circumstances no contract imposing on the<br />

Association a liability in excess of $5,000 will be entered into by the<br />

Association on behalf of any Group, Zone, Region or other part of the<br />

Association unless such contract shall contain a provision limiting the<br />

Associations liability to the extent of the assets of the Group, Zone or other<br />

part of the Association on whose behalf the Association is contracting.<br />

(d)<br />

Joint Ownership:<br />

Groups, Zones, Regions or other parts of the Association wishing to hold<br />

property jointly with any other organisation, must first submit an agreement<br />

setting out the rights and liabilities of the parties, to National Office, for<br />

approval.<br />

(e)<br />

Disposal<br />

When land or buildings are to be sold or otherwise disposed of prior consent<br />

must be obtained from the National Office. Where the purpose for which the<br />

asset was held has become redundant the proceeds will be used for the benefit<br />

of SCOUTS New Zealand at Zone, Region or National level. <strong>The</strong> National<br />

Executive Committee will determine the actual allocation of funds.<br />
