Covenant on Economic, Social and Cultural Rights (ICESCR).<br />

At a regional level, the European Court of Human Rights<br />

(ECtHR) is competent <strong>to</strong> hear complaints referring <strong>to</strong> the<br />

European Convention for the Protection of Human Rights and<br />

Fundamental Freedoms. The European Committee on Social<br />

Rights (ESCR) is competent for collective complaints against<br />

the States Parties <strong>to</strong> the Additional Pro<strong>to</strong>col <strong>to</strong> the European<br />

Social Charter Providing for a System of Collective Complaints<br />

(“Additional Pro<strong>to</strong>col of 1995”) and those who accepted the<br />

collective complaint mechanism through a declaration under<br />

Article D of the European Social Charter (revised). The ESCR is<br />

competent <strong>to</strong> consider complaints only against those rights of<br />

the European Social Charter by which the State Party has<br />

undertaken <strong>to</strong> be bound. 689<br />

The Inter-American Commission on Human Rights (IACHR),<br />

established by the OAS Charter, 690 is competent 691 <strong>to</strong> consider<br />
