The pandemic has made the question
topical again. Can dogs enter the lift or
not? Do they spread the virus? Is there a
risk to human health? No risk at all.
But it may be due to fear of falling ill,
nervousness or a trivial aversion to man’s
best friend, that, especially at the beginning of
the lockdown, handmade signs appeared here
and there throughout Italy, forbidding dogs to
enter lifts, whether private or public
lifts.
Article 1138 of the Civil Code has for
some time now prohibited the “inclusion in
the condominium regulations of any rule
preventing the possession or keeping of pets”.
By extension, therefore, it is considered that
pets have every right to attend or pass through
the common areas, as long as they behave in
a polite and respectful manner. As you can
imagine, this means that dogs must not soil,
damage plants in the garden or the grass, or
disturb by making noise during the hours of rest
at night and in the afternoon.
Needless to say, the responsibility lies with
the owner of the animal, who must take
prompt action in the event of an “accident” or
prevent any unpleasant situations with a good
behavioural training for their beloved fourlegged
friends.
TO USE THE LIFT OR NOT TO USE THE LIFT?
The website animalidacompagnia.it reminds
us that ‘Italian Presidential Decree No 162/99
prohibits the use of lifts and goods lifts by
persons under 12 years of age who are not
supervised’, but does not refer to animals.
It would seem, therefore, that there is no
problem with vertical systems, although there
are still ambiguous interpretations in civil case
law. On the other hand, there is
no doubt about dogs accompanying people with

diciamo subito: no, nessun rischio. Ma sarà per la
paura di ammalarsi, per i nervi tesi o per una banale
avversione verso il miglior amico dell’uomo, che,
soprattutto agli inizi del lockdown, sono apparsi,
un poʼ qui un poʼ là per l’Italia, cartelli artigianali
nei quali si vietava l’ingresso dei cani in ascensore,
condominiale o urbano che fosse.
Grazie all’articolo 1138 del Codice civile, da
ormai qualche tempo, è fatto divieto di “inserire
nel regolamento condominiale qualsiasi norma che
impedisca il possesso o la detenzione di animali
domestici”. Per estensione quindi, si ritiene che
gli animali domestici abbiano tutto il diritto di
frequentare o transitare per le aree comuni, a patto
che si comportino in modo educato e rispettoso
degli spazi e degli altri. Come è facile immaginare,
ciò significa che i cani non devono sporcare,
rovinare le piante in giardino o il manto erboso, o
disturbare facendo rumore durante le ore destinate
al riposo notturno e pomeridiano. Inutile dire quindi
che la responsabilità è tutta a carico del proprietario
dell’animale, il quale dovrà provvedere prontamente
in caso di “incidente” o prevenire eventuali
situazioni spiacevoli con un solido addestramento
comportamentale dell’amato quattro zampe.
SALGO O NON SALGO?
In materia prettamente ascensoristica, lo
ricorda anche il sito animalidacompagnia.it,
il “d.p.r. n. 162/99 vieta ‘l’uso degli ascensori
e dei montacarichi ai minori di anni 12, non
accompagnati da persone di età più elevata’,
ma non si esprime con riferimento agli animali.
Sembrerebbe quindi che sul versante impiantistico
verticale non ci sia alcun problema, permangono
purtroppo ambiguità interpretative nella
giurisprudenza civile. Nessun dubbio invece per
